Opposing SB 1201 (Ellis) Relating to the Setting of Rental Rates for Maritime Tenants on Port District Property b. Resolution 7/y sing SB 1202 (Ellis) Relating to the Election of San Diego Unified Port Commissioners SUBMI'r1 BY: Assistant City Attorney (4/5ths Vote: Yes No X ) SB 1201 and SB 1202 introduced by Senator Ellis relate to rental of tidelands and the election of Port District Commissioners respectively. RECOMMENDATION: Adopt resolutions. BOARDS/ccti'aSSIONS RECOMMENDATION: N/A DISCUSSION: On March 8, 1985, Senator Ellis introduced SB 1201 and SB 1202. SB 1201 authorizes the State Lands Commission to consider the appropriate rental rate for tidelands and provides that said Commission consider the use of tidelands for maritime industry. Presently, the rental of tidelands has an arbitration provision for the local settlement and resolution of said rental rate. This bill, if adopted, would remove this local control to the state level, thus, further eroding the ability of local jurisdictions to address specific concerns. SB 1202 specifically relates to the election of the seven member San Diego Unified Port District Commissioners. Said Commissioners are presently appointed by the legislative bodies of the Port District cities. The adoption of this bill would require that the Port District Commissioners be elected by the citizens of those cities. The election of the Port District Commissioners would weaken the ability of the City Council to hold the Commissioners accountable for their activities. An elected Port District Commissioner could only be removed pursuant to the recall provisions of the Election Code. On March 12, 1985, your City Council voted to oppose SB 1202.
