As a result of Council approval of a report on Las Flores Drive and "D" Street
between Second Avenue and Minot Avenue north of "E" Street at their meeting on
December 18, 1984, the City Council approved a recommendation which directed
staff to proceed with the formation of an assessment district for modified
zone 1 along Las Flores Drive north of "D" Street. In order to proceed with
the formation of this assessment district, it is recommended
RECOMMENDATION: That City Council :
1 . Approve agreement with F. MacKenzie Brown Incorporated to act as
Special Counsel for the proposed Assessment District 85-1 (Las Flores
Drive).
2. Approve an agreement with Bement-Dainwood-Sturgeon to act as
Assessment Engineer for proposed Assessment District No. 85-1 (Las
Flores Drive) .
3. Approve an agreement with Algert Engineering, Inc. to act as Engineer
of Work for proposed Assessment District No. 85-1 (Las Flores Drive) .

DISCUSSION:

In the process of forming Assessment District No. 85-1 (Las Flores Drive) ,
three areas of expertise are needed. These areas include special legal
counsel , an assessment engineer, and an engineer of work. The following is a
brief description of the work to be performed by these consultants.
1. Special Counsel
a. Review of the dedication and acquisition of streets and easements or
other property in which proposed work is to be performed.
b. Examination of plans and specifications for the proposed work, the
boundary map, and assessment diagram of the Assessment District; the
assessment roll and bonds and the giving of instructions and advice
in connection with the foregoing.
c. Recommendations as to procedure, schedules, and actions that should
be conducted and taken.
d. Preparation of all resolutions, notices, contracts, bond forms, and
other papers and documents required in the proceedings.
e. Examination of the proceedings, step by step, as taken.
f. Appear at all hearings under the proceedings and attend any meetings
where attendance is requested.
g. Make recommendations as to sale of bonds if desired.
h. Perform legal services if required pursuant to the provisions of the
"Special Assessment Investigation Limitation and Majority Protest Act
of 1931 ," being Division 4 of the Streets and Highways Code of the
State of California.
i . Issuance of an approval and legal opinion attesting to the validity
of the proceedings and the issuance of the bonds.
2. Assessment Engineer
His work will consist of assembly and presentation of an engineer' s report
as outlined in Section 10204 of the "California Streets and Highways Code"
containing the following documents:
a. Boundary map
b. Construction plans and specifications
c. Description of work and estimates of construction and incidental costs

d. Description of all right-of-way easements and lands to be acquired
and costs
e. Assessment diagram indicating the district and land division within
the boundary metes and bounds
f. Assessment roll indicating proposed assessment to individual parcels
g. Attend all meetings public or private and assist in bidding
procedures and contract negotiations as necessary.
3. Agreement with Engineer of Work includes:
a. Preparation of plans, specifications, and cost estimates
b. Coordination and processing of plans and work with the various
utility companies
c. Appear at all hearings under the proceedings and attend any meetings
where attendance is requested.
The firms of F. MacKenzie Brown, Inc. , Bement-Dainwood-Sturgeon, and
Algert Engineering, Inc. were selected because of their expertise in the
various fields and past involvement and history of the project.
FISCAL IMPACT: The City's cost will include $26,000 from funds previously
budgeted. The monies will be reimbursed to the City should the assessment
district be approved by the City Council .
