HomeMy WebLinkAboutAgenda Statement 1985/02/26 Item 19 COUNCIL AGENDA STATEMENT Item 19 Meeting Date 2/26/85 ITEM TITLE: Resolution //y-5V Approving first amendment to agreement for temporary connection and sewage transportation between Chula Vista, San Diego and Montgomery Sanitation District SUBMITTED BY: Director of Public Works/ City Engineer (4/5ths Vote: Yes No x ) REVIEWED BY: City Manager // In December 1983, City Council approved an agreement (Resolution 11489) with San Diego, Montgomery Sanitation District, Otay Water District and Otay International Center authorizing construction and operation of the Otay Mesa Sewer, and temporary use by San Diego of the Date-Faivre Trunk Sewer. That agreement stipulates the maximum extent of temporary use of the Date-Faivre sewer and the area of service for which such temporary use was intended. On April 24, 1984, City Council approved a second agreement (Resolution 11608) authorizing utilization of a minor portion of the capacity in the Date-Faivre sewer by an area within San Diego but not within the stipulated service area of the December 1983 agreement referenced above. The April 24, 1984 agreement established a maximum number of equivalent dwelling units (EDUs) to be served thereunder as 212 units. Robinhood Homes has requested permission to serve an additional 144 dwelling units on a neighboring property to that initially approved for service. This increase necessitates approval of an amendment to the agreement which the Council approved on April 24, 1984. RECOMMENDATION: That Council adopt the resolution approving the amendment to the agreement (Resolution 11608) and authorizing the Mayor to execute such amendment. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The April 24, 1984, agreement which is proposed to be amended was designed to provide capacity in the Date-Faivre trunk sewer on a temporary basis for 212 units in a development known as Palm Pacifica. A neighboring property by Robinhood Homes has requested permission to serve an additional 144 dwelling units via the gravity line built by Palm Pacifica. The development will make temporary use of capacity in the Date-Faivre trunk sewer temporarily held by the City of San Diego. The proposed amendment does not alter the conditions or the total flow authorized to the City of San Diego under the December 1983 agreement. In substance, this flow will be included in the aggregate flow from Otay Mesa insofar as its impact on the capacity of the Date-Faivre trunk sewer is concerned. Page 2, Item 19 Meeting Date Z/'L5/S5 The Montgomery Sanitation District has already approved this amendment. Similar action by the City of San Diego is expected in late February. The volume of flow involved in this request is relatively insignificant in terms of the total volume which will be permitted to temporarily utilize the Date-Faivre sewer under the December 1983 agreement. Engineering staff sees no cause for concern in approving the proposed First Amendment to the April 24, 1984 (Palm Pacifica) agreement. Engineering staff, however, does not recommend that any further such connections be allowed unless clearly necessary to protect public health, safety and welfare. Letters to such effect are being sent to both the City of San Diego and the County of San Diego. FISCAL IMPACT: No direct fiscal impact on the City. WEN:fp/KY013 WPC 1367E '� r 5�--
