HomeMy WebLinkAboutAgenda Statement 1985/02/05 Item 11 COUNCIL AGENDA STATEMENT Item 11 J Meeting Date 2/5/85 ITEM TITLE: Resolution �/ /Accepting Covenant of Improvement Requirements for Marina Gateway Business Park water line SUBMITTED BY: Community Development Directo .-/5ths Vote: Yes No x ) REVIEWED BY: City Manager,' ; In order to complete the Amex project and future construction of the Marina Gateway Business Park (Bay Boulevard between "J" and "L" Streets), a water line must be constructed from "J" Street to the building sites. The water line will have to cross or go underneath a large concrete drainage channel located just south of "J" Street. The developer wishes to follow the Bay Boulevard street improvements and construct a pipe over the channel . Sweetwater Authority is willing to accept the developer's plan, if the Water Authority is not responsible for any adjustments to the above ground pipe in the event that Bay Boulevard is ever widened. Therefore, approval of the improvement has been conditioned upon the City of Chula Vista's written assurance that Sweetwater Authority will not have to pay the bill if the pipe is moved to further improve the street. In an effort to gain condition of approval , the developer has prepared a Covenant of Improvement Requirements which will indemnify the City should it ever be necessary to move the water line. The Covenant will run with the land and will bind subsequent owners. RECOMMENDATION: That Council accept the Covenant of Improvement Requirements for Marina Gateway Business Park water line, direct the Mayor to execute said document, and direct staff to send a letter to Sweetwater Authroity releasing them from future responsibility in relocating the water line. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Currently, there is no water line in Bay Boulevard south of "J" Street; therefore, Ratner Development Co. must construct a new line to serve Marina Gateway Properties. The closest extension point is in "J" Street. The developer has reviewed two methods of installing the water line past the concrete drainage channel which crosses Bay Boulevard and the project site. The first method of construction involves locating the pipe within an iron sleeve beneath the channel. A corrosives engineering report, including water table and salinity information would be required and considerable excavation necessary for construction. This is a time consuming process and very costly. Page 2, Item 11 Meeting Date 2/5/85 An pla , which has been proposed by the developer, is to install the water alternative line n in Bay Boulevard and then angle the line westward through the berm area at the edge of the street as it crosses the drainage culvert. This is a less costly method of construction; however, if Bay Boulevard street improvements were ever changed, it could cause the relocation of the water pipe and associated costs. (A future widening of Bay Boulevard at this location is unlikely however, since the developer will be improving the street to its full width. ) The developer has chosen the alternative installation due to the cost and time involved. Sweetwater Authority has reviewed the plan and accepts it from an engineering point of view. It does deviate from normal policy, however, and could result in future costs to the Authority if the pipe line were to be relocated at a future date. Therefore, the Water Authority requests assurances from the City that no future financial impact will result to them due to this alternative plan. The developer has prepared a Covenant which assures the City that any costs incurred due to future relocation of the water line will be the burden of the owner of the Marina Gateway Properties not the City (Attachment I) .
