HomeMy WebLinkAboutAgenda Statement 1989/09/05 Item 25 COUNCIL AGENDA STATEMENT Item 25 Meeting Date 9/5/89 ITEM TITLE: Public Hearing - Consideration of the Extension of an Urgency Ordinance Establishing a Development Impact Fee for the Improvement and Construction of Various Public Facilities in the City of Chula Vista Interim Ordinance P333 - Extending an Interim Development Impact Fee to Pay for the Improvement and Construction of Various Public Facilities within the City of Chula Vista SUBMITTED BY: Budget Officer REVIEWED BY: City Manager &l 4/5ths Vote: Yes x No On August 8, 1989, the City Council adopted an ordinance establishing an interim Development Impact Fee to pay for the improvement and construction of various public facilities within the City of Chula Vista, as well as a regular ordinance establishing a Development Impact Fee for the same improvements. The regular ordinance will take effect 67 days after its first reading. State law requires that the interim ordinance only be in effect for 30 days, and may be extended twice so that there is no gap between the interim ordinance and the effect of the regular ordinance. As the interim ordinance will expire on September 7, 1989, it is necessary to extend the ordinance at this meeting should Council wish the urgency ordinance to remain in effect. RECOMMENDATION: Extend the urgency ordinance establishing a Development Impact Fee for public facilities. DISCUSSION: As indicated above, it is necessary to extend the urgency ordinance so that there will not be a gap before the regular ordinance comes into effect. It will be necessary to extend the urgency ordinance once more on October 3, 1989, as the regular ordinance will not become effective until October 14, 1989. Staff has sent notification of the extension of this ordinance to all individuals who have filed their building plans for permit plan check prior to August 9, 1989 but have not yet drawn a building permit. FISCAL IMPACT: The fiscal impact is as indicated on Attachment "H" to the report, inasmuch as between the years 1988 and 2010, it is estimated that approximately $42,468,760 will be generated by these fees except as they may be adjusted from time to time.
