D!kG .;AD rwC TION SUBMITTED BY: Director of PubltW '4Wety REVIEWED BY: City ManageO6.7 (4/5ths Vote: Yes No X ) ✓ Council Referral 71-503 At the December 6, 1988 Council Meeting, staff recommended changes in Section 10.28.090 of the Municipal Code designed to broaden the scope of regulations governing the riding of skateboards. These amendments extend the current prohibition to now include private property and specified public property. Staff was directed to return with a report that included a definition of "Business District," that gives additional examples of public property where skateboarding is prohibited and that provides for posting of prohibition signs in those areas where skateboarding is now damaging property. RECOMMENDATION: That Council place the ordinance on first reading. • BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The Police Department understands that those who ride skateboards do so for enjoyment and fun. We want to authorize their use in areas that will provide safety to the riders as well as the general public. The predominant problems created by skateboards are property damage, citizen safety, and civil liability. The property damage generally caused by skateboards is to cement and tile which end up chipped or broken. The problem of public safety is predominantly related to private property, where they can disturb the residents or patrons. On private property there is also an additional level of danger for both the rider and the citizen, since a citizen does not expect to see a skateboard come flying around a corner into areas generally intended for pedestrian traffic. The Police Department receives many complaints from property owners throughout the City. The complaints come from apartment managers, senior citizens in the downtown areas, shopping centers, the trolley station, and from citizens living near concrete drainage ditches. • • • Page 3, Item • Meeting Date _sawn lily/0 devices upon any public street, bridge, underpass, sidewalk, sidewalk space or public property between the hours of sunset and sunrise. Skateboard shall mean a board with wheels affixed to the underside, designed to be ridden by persons. (Ord. 973 S I (part), 1966: prior code S 19.16.1. ) Basically, the revised ordinance extends the prohibition of skateboards beyond the current "business district of the city" to include "parking structures," "public grounds where people assemble," and/or "the private property of another without written consent of the property owner." Staff will have signs posted in these public areas where skateboarding is now creating problems.
