RECOMIENDATION: Place the Ordinance on its First Reading BOARDS/COMIISSIONS RECOMMENDATION: N/A DISCUSSION: At the February 28, 1989 meeting of the City Council, the Council directed the C' Attorney's office to bring back an ordinance pursuant to Charter Section which would establish a City Council policy to fill the position of mel Director "in house" prior to seeking "outside" candidates for the office. Charter Section 305 states as follows: The Mayor and the councilmen are hereby individually and collectively prohibited from performing any administrative or executive functions except as same may be authorized by this Charter or by ordinance of the City of Chula Vista. They objected to what they felt were the following inferences: Cl ) that their petition to submit the 1988 rent increase was late; (21 that utility costs would go down as a result of individual metering; and (3) that the delays in the previous negotiations were attributable to the residents. Staff regrets any statements or inferences in the report which might be taken as facts pertinent to the dispute. Staff has only made a preliminary review of the documents on hand and has not reached any conclusions as to how the merits of this dispute should be resolved. The staff report also noted that the mobilehome park owner has been "forthcoming" in this matter. The Residents negotiating Committee has been forthcoming as well as the report indicated in the "Analysis" Section, where it is stated,"the process has been pursued in good faith by both parties".
