Amending Section 9.60.030 of the Chula
Vista Municipal Code relating to Exemptions for the Sale of
Mobilehome Parks

This amendment would allow mobilehome park owners to change the method by
which they hold title to the park without this being deemed a sale triggering
the right of first refusal of the park tenants.

DISCUSSION:
At its Feoruary 14, 1989 meeting, the City Council received a written
c ication from Lynwood South Mobile Estates requesting an amendment to
on 9.60.030 of the Municipal Code which deals with exemptions from the
sions relating to the sale of mobilehome parks. The mobilehome park in
question is owned by a limited partnership which wants to change its method of
holding title to a Chapter "S" corporation. The shareholders of the
corporation would include all the partners of the current limited
partnership. Our current exemptions include transfers by a corporation to an
affiliate and transfers by a partnership to any of its partners. It appears
that we tried to anticipate various situations whereby owners change their
method of holding title, but that we left some out. The amendment would allow
changes in the method of holding title where the proportional ownership
interests of the coowners does not change. The proposed amendments,
therefore, seem consistent with the intent of the ordinance which is to
protect tenants when the park is sold to a new party.
