WHEREAS, It is necessary that the fire protection resources and facilities of San Diego County and the various political subdivisions of San Diego County entering into this Agreement and Operational flan be made available to prevent and combat the effect of fire which may result from a disaster within the limits of the county of any type of a lesser nature than a disaster requiring a declara- tion of a State of Extreme Emergency; and WHEREAS, It is desirable in the event such a disaster should occur that each of the parties hereto should voluntarily aid and assist each other by the inter- • change of fire protection services and facilities to cope with the.problems which would arise in the event of disaster; and WHEREAS, It is necessary and desirable that a cooperative agreement and • •• operational plan be executed for the interchange of such mutual aid on a local ..• and county wide basis; Now, Therefore, it is hereby agreed by and between the cities of San Diego, Chula Vista, Coronado, El Cajon, Escondido, La Mesa, National City, Oceanside and the County d San Diego, as follows: 1. Each party agrees to furnish fire protection personnel, resources, and facilities and to render such fire protection services to each and every other party to this agreement as may be necessary to prevent and combat any type of • disaster of a lesser nature than a disaster requiring a declaration of & State • of Extreme Emergency within the limits of the County of San Diego, in accordance with the following duly adopted mutual aid plan detailing the manner by which such personnel, resources, facilities and services are to be made available and furnished; provided, however, that no party shall be required to deplete un- reasonably its own fire protection resources, personnel, services, and facilities in furnishing such mutual aid. - • 2. The consideration for this Agreement shall be the promise of each party to assist the others and it is understood that no party shall be liable to reim- burse any other party for aid furnished pursuant hereto; it is further understood and agreed that such mutual aid is intended to be available only in the event of a disaster of such magnitude that it is, or is likely to be,. beyond the control of a • single party and requires the combined forces of several or all of the parties to • this agreement to combat. • Page 1 of 4 C aL‘ e/ 3. It is expressly understood that any mutual aid extended under this Agreement and this Operational Plan is furnished in accordance with provisions of the "California Disaster Act and other applicable provisions of law, and especially as otherwise provided by law that the responsible local fire official in whose jurisdiction an incident requiring mutual aid has occurred shall remain in charge at such incident including the direction of such personnel and equipment provided him through the operation of such mutual aid plans (Sec. 1564 Military and Veterans Code). • 4. It is expressly understood that additional parties wishing to participate • in this mutual aid Agreement and Operational Plan may do so only with the approval . . ' of. all parties already participating and with the approval of the State Disaster Council. 5. Upon approval and execution of this Agreement and Operational Plan by the • parties hereto, this agreement and mutual aid operational plan shall remain in full force and effect until. this Agreement and/or Operational Plan be amended, revised, and modified. 6. This Agreement and Operational Plan shall be submitted to the State • Disaster Council for approval. The State Disaster Council shall be requested to • notify each party to this Agreement and Operational Plan of its approval. • 7. Any party subscribing to this Agreement and Operational Flan may, at any time, by resolution or notice given to the remaining parties and to the State • Disaster Council, decline to participate- in this Agreement or Operational Plan, which declaration shall become effective twenty days after filing with all • remaining parties and the State Disaster Countil. • 8. The State Disaster Council shall be requested to send copies of this Agreement and Operational Plan and other relative notices and information to the • parties of this Agreement and Operational Plan and to all officers of the several political subdivisions as designated by such parties. • 9. This Agreement and the Operational Plan shall become effective as to each party when approved or executed by that party, and shall remain operative and effective as between each and every party that has approved or executed (or hereafter approves and executes) this Agreement and this Operational Plan, until participation in such is terminated by the party. Page 2 of 4 The termination by one or more parties of their participation in this Agree- ment and this Operational Ilan shall not effect the execution of this Agreement and Operational Ilan as between the other parties subscribing thereto. 10. Approval or execution of this Agreement and Operational Ilan shall be . . by resolution by the county, and political subdivisions of the county, having a legislative or governing body. Upon adoption of such a resolution, a certified copy of this Agreement and this Operational Ilan shall forthwith be filed with the State Disaster Council and all parties agreeing thereto. 11. San Diego County, and the political subdivisions of the county having a legislative or governing body, shall, by resolution, give notice of termination of participation in this Agreement and this Operational Ilan and file a certified copy of such resolution with all participating parties and with the State Disaster • Council, and this Agreement and Operational Flan is terminated as to such parties twenty days after the filing of such resolution. • OPERATIONAL FLAN Be it resolved by the City Council of the city/political subdivision/ of Chula Vista , California, and by authority of the same that; Section 1, No request for mutual aid relative to fire protection outside the corporate limits of Chula Vista , California, shall be answered by the fire department of said city/political subdivision/ unless the request be channeled through normal communication media and be made by the Fire Chief or other responsible fire official of the city or political subdivision requesting mutual aid. . Section 2. All requests for mutual aid relative to fire protection outside the corporate limits of Chula Vista , California, shall be channeled directly to the Fire. Chief or other responsible fire official of the city/political subdivision/ of Chula Vista , who shall make and execute all decisions involving use of fire department equipment and personnel under his jurisdiction in acting upon the request. The Fire Chief or other responsible fire official shall be responsible for any action taken by his department relative to such mutual aid requests. Section 3. The Fire Chief or other responsible fire official designated by /age 3 of 4 the Fire Chief within whose jurisdiction a disaster of a magnitude requiring mutual : . . aid has occurred shall remain in charge of fire protection activities incident to the disaster, including the direction of all equipment and personnel provided him through mutual aid. He may direct responding mutual aid personnel and equip- ment to the scene of the disaster or to designated rendezvous stations, or take any other fire protection action utilizing such mutual aid equipment and personnel as dictated by circumstances pertinent to the disaster. Section 4. Nothing contained in this Agreement or Operational Plan shall be construed as a contract binding in any way upon the city/political subdivision/ of Chula Vista , California, to respond to any request for mutual aid . when, in the opinion of the Fire Chief or other responsible fire official of the • fire department of the city/political subdivision/, it is impractical to respond to such request at the time and place under the circumstances then existing; or if, according to his judgment, such response would deplete fire protection resources, equipment, and personnel under his jurisdiction below a safe fire protection level for the city/political subdivision/ under conditions and circumstances then existing; or if local fire department equipment and personnel is being used else- - where, either within or outside of the limits of-the city/political subdivision/ in response to fire or other emergency. - . Section 5. Nothing contained in this Mutual Aid Agreement or Operational Plan shall be construed to impose any liability on said city/political subdivision/ or its fire chief and/or responsible fire officials for failure to extinguish fire or prevent the spread of fire or otherwise successfully engage in or complete mutual aid operations. Neither shall said city/political subdivision/ or its fire chief and/or responsible fire officials be liable for any damage to life, limb, or property by reason of said fire department equipment, personnel, and resources responding to any mutual aid request; or for failure to respond to any request for mutual aid. WHEREAS, the County of San Diego, hereinafter referred to as the County, and the incorporated cities within the County signatory hereto, hereinafter referred to as the City or Cities as required by the context, are desirous of establishing a unified civil defense organization hereby designated as the UNIFIED SAN DIEGO COUNTY CIVIL DEFENSE AND DISASTER ORGANIZATION for the purpose of preparing mutual plans for the preservation and safety of life and property and making provision for the execution of those plans in the event of enemy attack upon the United States • and to provide for mutual assistance in the event of a natural disaster; and, WHEREAS, the parties to this agreement are desirous of providing for any un- encumbered balances at the end of the budgeted year resulting from either budget savings or revenues derived from Federal funds. They, in consideration of the mutual covenants herein contained, do hereby mutually agree as follows: A. The County will perform the following services: 1. Aid, assist and advise each city in the preparation and development of a disaster plan for that city. 2. Prepare and develop a County-wide civil defense plan which shall pro- vide for the needs of the contracting cities and of the unincorporated areas of the County and which in addition will take into account and be coordinated with the needs of the cities in the event of a major natural disaster.' • 3. Aid, assist and advise the cities with the training of public em- - ployees for the city disaster organizations. 4. Provide a County-wide civil defense program in each of the following • areas: a) Coroner services b) Health c) Welfare d) Traffic control e) Medical f) Public information g) Radiological safety 5. Develop and keep current on a County-wide basis an inventory of all the equipment and supplies available now in the County for use in the event of emergency. 6. Provide technical assistance in obtaining any federal or state funds which may become available to the cities for civil defense purposes • and in the acquisition by the cities of surplus property for civil • defense purposes. 7. In'the event of a disaster confined to one city, the County will offer • assistance within the limits of its civil defense organization and • willcoordinate assistance furnished by other cities in accordance with mutual aid agreements. • • • 8. In the event of a disaster within the County affecting an area greater • - • than any one city, the County shall offer assistance to the extent of • its civil defense establishment and shall direct and coordinate the assistance furnished by other cities. B. The cities shall: 1. By becoming signatories hereto become members of the Unified San Diego • County Civil Defense and Disaster Organization. • 2. Become parties to such mutual aid agreements as shall be deemed nec- essary by the Unified San Diego County Civil Defense and Disaster Council, established herein. �r • /0 "44 3. Accept primary responsibility for the development within that city of a disaster plan which shall be compatible with and complementary to the County-wide civil defense plan and organization to be developed pursuant to Paragraph A (2) above. 4. Delegate to the Unified San Diego County Civil Defense and Disaster Council established herein whatever authority it is lawful for the cities to delegate when such delegation shall be deemed necessary by said Council. This delegation of authority shall be- restricted to a' `•:<`? :: whatever expenditure of city funds and use of city personnel, equip- ment and supplies as are made available by the cities for civil defense purposes. C. In consideration of these mutual promises, it is hereby mutually agreed: 1. That the County will pay fifty percent (50%) of the cost of establish- _ ing and maintaining the Unified San Diego County Civil Defense and Disaster Organization. 2. That the cities signatory hereto will pay fifty percent (50%) of the cost of establishing and maintaining the Unified San Diego County Civil Defense and Disaster Organization, said fifty percent (507) to • • be apportioned among the cities in accordance with the following for- mulae: One-half of the 50%, or 25% of the total budget, to be apportioned by people units or population: • (a) Total population of all contracting cities divided into one- fourth of the total budget equals a factor in cents. • (b) Population of each contracting city times the factor in cents equals the share for each city. • The remaining 25% of the total budget to be apportioned by value units--assessed valuation of each city. (a) Total assessed value of real and personal property in all con- tracting cities divided into one-fourth of the total budget equals a factor in mills. (b) Assessed value of each contracting city times the factor in mills equals the share for each city. -. • 3. (a) For the purposes of this agreement the total assessed valuation of real and personal property in all the contracting cities shall be the amount assessed in the fiscal year prior to the budgeted year, as found in the Property Valuation and Tax Rate--San Diego County, California, published by the Auditor and Controller of .. • • the County of San Diego. (b) The figures used for population in each city shall be determined by a method which is mutually acceptable to all signatories hereto. • . •• 4. If at the end of any fiscal year there remains an unemcumbered balance • derived from budget savings or revenue from Federal funds received for civil defense purposes, such balance shall be credited to the con- tracting cities at the rate of their contribution for that fiscal year towards the following fiscal year for the expenditures of the Unified San Diego County Civil Defense and Disaster Organization. In the event a contracting city withdraws from this agreement, such city will receive its refundable share of the unencumbered balance for that fiscal year and this amount is to be made by a single payment. • E-4 4 D. The Unified San Diego County Civil Defense and Disaster Council is hereby created and designated as the advisory body of the Unified San Diego • County Civil Defense and Disaster Organization. It shall consist of the • following: 1. The Chairman of the Board of Supervisors who shall be Chairman. 2. The Coordinator of Civil Defense and Disaster who shall be Vice-Chair- man and who shall be selected by the Board of Supervisors from the following list: Chief Administrative Officer of the County or the City Manager and/or City Administrator of any incorporated city in the County which has become a party to this agreement. Two additional persons shall be selected from this list to act as • alternates in the absence or inability of the Coordinator to serve, • as first and second alternates. • 3. A representative from the City Council of each incorporated city with- in the County which has become a party to this agreement, or an alter- nate to be designated for each such municipal corporation. • E. It shall be the duty of the Unified San Diego County Civil Defense and Disaster Council and it is hereby empowered to review and recommend for adoption by the Board of Supervisors and all contracting cities, civil • defense and disaster mutual aid plans and agreements, and such ordinances, resolutions, rules and regulations as are necessary to implement such plans and agreements. The Unified Civil Defense and Disaster Council shall meet upon call of the Chairman or in his absence from the County, or inability to call such a meeting, upon the call of the Coordinator of Civil Defense and Disaster. The Civil Defense and Disaster Council shall be empowered to recommend a budget and the apportionment thereof to the Board of Supervisors and all contracting cities. F. There is hereby created the position of Coordinator of Civil Defense and Disaster. The Coordinator is hereby empowered: 1. To request the Board of Supervisors to proclaim the existence or threatened existence of a disaster and the determination thereof if the Board of Supervisors is in session or to issue such proclamation if the Board of Supervisors is not in session subject to ratification by the Board of Supervisors at the earliest practical time. 2. To request the Governor of the State of California through the Board of Supervisors to proclaim the existence of a state of extreme emer- 'gency when in the opinion of the Coordinator the resources of the area or region are inadequate to cope with a disaster or an emergency. 3. To' coordinate the efforts of the parties to this agreement for the • • accomplishment of its purposes. G. This agreement shall become effective upon the adoption of appropriate enabling ordinances by the County and the Cities. H. This agreement may be terminated as to any of the parties by written notice given by such party to all the other parties which notice shall be given at least 120 days prior to the commencement of the fiscal year in which it is to take effect.
