RESOLUTION No. 1439
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CHULA VISTA APPROVING AGREEMENT FOR
POUND SERVICES
THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES HEREBY
RESOLVE AS FOLLOWS:
That certain agreement between the COUNTY OF SAN DIEGO
and the CITY OF CHUTA VISTA, entitled "Agreement for Pound
Facilities and Services", dated July 1, 1953, a copy of
which is attached hereto, and by this reference made a part
hereof, be and the same is hereby approved, and the Mayor
and City Clerk of the City of Chula Vista are hereby
authorized and directed to execute the same for and on behalf
of the City of Chula Vista.

AGREEMENT FOR POUND FACILITIES AND SERVICES
The COUNTY OF SAN DIEGO, hereinafter referred to as the
COUNTY,, and the CITY OF CHULA VISTA, hereinafter referred to as the
CITY, agree as follows:
1. The City shall permit the use by the County of the City's pound
facilities as shelters for the impounding of dogs pursuant to the
County's Ordinance No. 1031 (New Series), as amended or hereafter
amended, from the following-described portion of the County:
All that portion of the unincorporated territory of the
County of an Diego lying southerly of the following
described line:
Commencing at the intersection of the most northerly
point of the boundary line of the City of San Diego
with the mean, high tide line of the Pacific Ocean; •
• thence southerly along the easterly boundary of said
City to its intersection with .the line dividing Township
14 South and Township 15 South, S.B.B.M. ; thence easterly
along said dividing line to the westerly boundary of
• Imperial County,
2. In addition, the City's pound personnel shall perform all pound
services normally provided for impounded dogs for all dogs
impounded pursuant to said 'Ordinance No. 1031 (New Series),: as

amended or hereafter amended, and shall collect all fees and
penalties required or permitted therein to be collected at a
shelter and account for and pay them over to the County's

- Auditor :t such times and in such manner as said Auditor shall
direct. At least one of the City's pound employees shall be
deputized by an appropriate County department head for the
purpose of receiving payment of the various fees and penalties
and the accounting and paying over of these fees to the County's

3. The City shall employ at least one additional pound employee in
order to permit the expeditious handling of these services for
the County.
4. In consideration of supplying of the foregoing facilities and
service e by the City, the County shall par to the City toward
. •
the salary of one additional employee to be employed by the City

at its Pound the sum of $232.00 per month for the months July
to October, 1953, inclusive; the sum of •244.00 per month for
the months November, 1953 to April, 1954, inclusive, and the
sum of $256.00 per month for the months of May and June, 1954,
making a total sum of $2,904000 for the fiscal year ending
June 30, 1954; and the County shall reimburse the Cityfor
pound expenses for dogs impounded pursuant to Said Ordinance
No. 1031 (New Series), as amended or hereafter amended, at the
rate of 50g per dog per day, or, if the actual expense of such
care exceeds the sum of 50g per day, the County shall reimburse
the City for such actual expense, but not to exceed 750 per dog
per day. Pound expensessas that term is used in this agreement
shall include confinement; feeding; destruction, disposal or
sale; public utility expenses; and cost of receiving and trans®
mitting messages regarding such dogs.
5. This agreement shall take effect July 1, 1953, and shall terminate
June 30, 1954-. In addition, either party hereto may terminate
this agreement at any time by giving to the other party 60 days'
written notice of intention toterminate. Such notice to the
County shall be served on the Clerk of the Board of Supervisors
of the County and such notice to the City shall be served on the
City Clerk of the City.
6. The City shall supply to the County Department of Public Works,
monthly, pn forms supplied by said Department, the following
statistical information:
1. Fees and penalties collected and licenses issued.
2. Dogs confined, fed, destroyed, or disposed of pursuant to said
Ordinance No. 1031 (Mau Series), as amended or hereafter amended.
7. The amounts specified in Paragraph 4 shall be paid by the County
to the City at the end of each month following receipt of the
information to be fun fished by the City under Paragraph 6 of
