RESOLUTION NO, 149h RESOLUTION GIVING NOTICE OF THE PROPOSED ANNEXA- TION TO THE CITY OF CHULA VISTA OF CERTAIN UN- INHABITED TERRITORY IN RANCHO DE LA NACION, IN THE COUNTY OF SAN D*EGO, STATE OF CALIFORNIA, TO BE KNOWN AS "CHULA VISTA TIDELANDS" ' THE CITY COUNCIL OF THE CITY OF CHULA VISTA DOES HEREBY RESOLVE AS FOLLOWS : WHEREAS the City of Chula Vista on the kith day of December, 1953, submitted to the County Boundary Commission of the County of San Diego a proposal for the annexation to the City of Chula Vista of the uninhabited territory described hereafter for a report as to the definiteness and certainty of the proposed boundaries, and WHEREAS the said Boundary Commission did not report upon the said petition ox proceeding within 20 days after it was submitted to it, and said petition is therefore deemed correct; NOW, THEREFORE, pursuant to and in conformity with the terms and provisions of Section 35002 of the Government Code and of the Annexa- tion of Uninhabited Territory Act of 1939: NOTICE IS HEREBY GIVEN of the proposed annexation to, and in- corporation and inclusion in, the City of Chula Vista of certain un- inhabited territory in the County of San Diego contiguous to 'the City of Chula Vista. Approved as to form by City Attorney of the City of Chula Vista, California.' • `ate r °• — `. • 1 r , 1 ti` t a ` . a ` That the said territory ib hereby designated as "CHULA VISTA TIDELANDS". • NOTICE IS FURTHER- GIVEN that on the 4th day of February, 1954, at the hour of Seven (7) o 'clock P.M. in 'the Council Chambers in the City Hall, Civic Center, Chula Vista, California, at a regular meet- ing of the City Council of said City, any person owning real property within such territory proposed to be annexed and having any objections to the proposed annexation, may appear before the City Council and show cause why such territory should not be so annexed. At any time not later than the said hour set for hearing objections to the proposed annexation, any owner of property within the terri- tory proposed to be annexed may file written protest against the pro- posed annexation. Such protest shall state the name or names of the owner or owners of the property affected thereby and the description and area of such property in general terms . NOTICE IS FURTHER GIVEN that proceedings are hereby initiated by the City Council of the City of Chula Vista, and that the said City Council desires said annexation for the following reasons : 1. The uninhabited territory proposed to be annexed is contiguous to the City of Chula Vista, and is composed of tidelands owned by the City of Chula Vista by virtue of a grant by the State of California and of submerged lands in San Diego Bay contiguous thereto. 2. That the annexation of the tidelands now owned by the City is desirable So that the City of Chula Vista may exercise its Tax and Licensing Authority over any property or activities which may here- after be located upon or conducted upon said tidelands . 3. That the annexation of the submerged lands in San Diego Bay contiguous to the tidelands owned by the City of ChulaVista is desir- able for the reason that it is anticipated that the State of Cali- fornia will grant to the City of Chula Vista additional submerged land lying Westerly of the present tidelands now owned by the City of Chula Vista. 4. That annexation of said'territory by the 'City of Chula Vista 0 will facilitate the future development of the bay frontage and tide- lands of the City. 5. That the City of' Chula Vista should have jurisdiction over that portion of the San Diego Bay lying adjacent to the balance of the territory within the City of Chula Vista. BE IT FURTHER RESOLVED, that the City Clerk of said City be, and he is hereby directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week; to-wit, on the 7th day of January, 1954 and on the 14th day of January, 1954 in The Chula Vista' Star, a newspaper of general circulation published in said City, and also in The Daily Transcript, a news- paper of general circulation published outside of the City but in the County in which is located the territory proposed to be annexed; said publication to be complete at least 20 days prior to the date set for the hearing. Said City Clerk shall also cause written notice of such proposed annexation to be mailed to each person to whom land within the terri- tory proposed to be annexed is assessed in the last equalized county assessment roll available on,the date these proceedings are initiated, at the address shown on said assessment roll, or as known to said Clerk, and to any person,who' has filed his name and address and the designation of the land in which he has any interest, either legal or equitable, with said Clerk. , In' the event any land within the territory proposed to bx £ annexed is owned by the County of San Diego said City Clerk shall also cause written notice of such proposed annexa- tion to be mailed to the Board of Supervisors of such County. The notices above referred to shall be given not less than 20 days before the said public hearing oh the proposed annexation. ADOPTED, SIGNED AND APPROVED this 31st day of December, 1953.
