TO RENDER CERTAIN SPECIAL ASSESS- MENT SERVICES, ALL AS CONTAINED IN HIS LETTER OF OCTOBER 1, 1953, AND AUTHORIZING AND DIRECT- ING THE MAYOR AND CITY CLERK OF THE CITY OF CHULA VISTA TO EXECUTE THE SAME FOR AND ON BE- HALF OF THE CITY, OF CHULA VISTA THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES HEREBY RESOLVE AS FOLLOWS: That certain proposal submitted by LAWRENCE J. THOMPSON to render certain special assessment services, all as contained in his letter of October '1, 1953, addressedito the City Council of the City of Chula Vista is hereby approved and accepted as a contract between the said LAWRENCE J.. THOMPSON and the CITY OF CHULA VISTA, and the Mayor and City Clerk of the City of Chula Vista are hereby authorized and directed to execute the same for and on behalf of the City of Chula Vista. Box 513 October 1, 1953 The Honorable City Council City of Chula Vista California Re: Paving Project Gentlemen: In connection with the proposed paving project now underway in the City of Chula Vista, pursuant to the provisions of Division and Division 7, of the Streets and Highways Code (Improvement Act of 1911), I herewith submit a proposal to render certain special assessment services as required by law, as follows: A. The City of Chula Vista to furnish: (1) Printed forms, postage, post cards, printed notices, legal advertising, binders, lithographed bonds; (2) Engineerimg data, cost estimates, Map of Assess- ment District, etc.: (3) Preliminary Map, and a triplicate set of final assessment diagrams. B, The undersigned will render and perform the following services: Section l,► Pursuant to said Division 4 (sometimes known as Debt Limit Proceedings). (1) Make a very careful field survey of all proper- ties to be assessed, keeping in mind the im.. provement to be made adjacent to the respective :• properties so that a fair and equitable assess- ment may be prepared; (2) Prepare a list of all property owners names and addresses, together with the assessed valuations of:their respective properties; (3) Search City records for the existance of unpaid special assessment liens, affecting said properties; (1.) With maps, plans, and estimates furnished by the Engineer of Work, together with the above inform ation and data, prepare a preliminary assessment and report as required by Division 14., Streets and Highways Code (Special Assessment Investigation, Limitation and Majority Protest Act of 1931) and file same with the City Clerk; �,w , i5) Prepare for mailing, postal card notices to property owners, relative to hearing on said report; • (6) Attend said hearing, answer questions, explain . report and provide such other assistance as may be required; • (7) Assist the Engineer of Work in preparing a report relative to the percentage of protests (if any); • ' Section 2, Pursuant to Division 7,. (Improvement Act of 1911)0 • (1) Prepare for mailing, postal card notices to property owners on adoption of Resolution of • Intention; (2) Attend hearing on Resolution of Intention and *answer questions and supply such information as may be required of me; (3) Assist Engineer of Work in preparing report on percentage of protests filed against said • Resolution of Intention; • (1.) After construction work has been completed, prepare the Contractor's Assessment Roll and file same with City Clerk; • (5) Prepare for mailing, postal card notices to property owners relative to the hearing on the assessment as filed; • (6) Attend hearing on the confirmation of the assess- ment, answer questions, and provide the required information; (7) At the conclusion of the 30 day cash collection • -•• period, audit payments made to the contractor, • . (or his assignee) and assist Street Superintendent in posting payments on his assessment roll; • • (8) Prepare a list of unpaid assessments and deliver to City Treasurer; (9) Prepare a Street Improvement Bond for each unpaid -assessment of $25000 or over and deliver same to • •City Treasurer; . (10) Prepare Treasurer's Bond Register, showing detailed . information of interest and principal installment coupons, and from which register.annual -bills of amounts due are prepared for mailing to property owners 0 • • • .2- Section 3. The total compensation to be paid the undersigned for the above services shall be as follows: (A) In the event the City of Chlua Vista requires the services as detailed in Section .1, above, (pursuant to Division ., Streets and Highways Code), compensation for these services shall be 2 of 1% of the estimated construction cost as determined by the Engineer of Work and as used in the said preliminary assessment and report. The said compensation shall be due and payable upon filing of said preliminary assessment and report with the City Clerk. (B) For all services rendered as detailed in Section 2, above-(Division 7, Streets and Highways Code) compensation shall be of the final construction 3 cost, due and payable as fo rws: . 11(( (1) The sum of Three Thousand and no/100 Dollars, 43000.00) shall be due and payable to the under- Irma } 1_ signed upon the signing of the contract by the successful bidder. ( Note: This amount must and will be advanced to the City by the Contractor). (2) One half (2) of the balance shall be due and payable to the undersigned upon confirmation of the Contractor's Assessment Roll by the City ( Council.
