RECOMMENDATION: Adopt the amendment adding new Section 9.50.065 and do not
adopt the amendment to Section 9.50.040

DISCUSSION:
During our recent discussions with representatives of the Negotiating
° -mmittee at the Bayscene Mobilehome Park, we became aware of a deficiency in

This ordinance amendment would require the park owner to notify each resident
subject to the increase who the other residents are that are also subject to
the increase. In addition, it would require the owner to notify any resident
or group of residents who express interest in notification of all rent
increases.
Council expressed an interest in amending the ordinance further to state that
the residents need only substantially comply with the time limit on filing a
petition. This could create more problems than it solves and may be
unnecessary with the new notice requirement. It also conflicts with the
current, provision in the ordinance that calls for the process to be
accomplished in a timely i

Substantial compliance is sufficient to meet the timeliness
requirement for filing a petition.

On a related subject, representatives of the Bayscene Residents Negotiating
Committee expressed objection to some of the statements in an earlier report
to Council . They objected to what they felt were the following inferences:
(1 ) that their petition to submit the 1988 rent increase was late; (2) that
utility costs would go down as a result of individual metering; and (3) that
the delays in the previous negotiations were attributable to the residents.
Staff regrets any statements or inferences in the report which might be taken
as facts pertinent to the dispute. Staff has only made a preliminary review
of the documents on hand and has not reached any conclusions as to how the
merits of this dispute should be resolved.
The staff report also noted that the mobilehome park owner has been
"forthcoming" in this matter. The Residents Negotiating Committee has been
forthcoming as well as the report indicated in the "Analysis" Section, where
it is stated,"the process has been pursued in good faith by both parties".
