ITEM TITLE: Resolution /�# .1O Ordering the Summary Vacation of Research
Court in Otay Valley Industrial Park

Subsequent to the recordation of the map of Otay Valley Industrial Park (Map
No. 10974) in 1984, San Diego Gas and Electric Company purchased approximately
half of the subdivision. That purchase included all of the lots surrounding
Research Court. The plans for development of the property do not require a
dedicated street and SDG&E has requested that the City vacate all of Research
Court.
RECOMMENDATION: The City Council adopt a resolution summarily vacating
Research Court.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
In 1984, Sammis Properties subdivided its 40-acre parcel on the west side of
Maxwell Road north of Otay Valley Road. The subdivision, known as Otay Valley
Industrial Park, contained 19 lots and two dedicated cul de sacs, Design Court
and Research Court. After the time the map was recorded and before
development work on the site had been completed, San Diego Gas & Electric
Company (SDG&E) purchased Lots 11 through 19 of the subdivision. (See Exhibit
"A" , attached. )
SDG&E plans to construct a regional service center on the property.
Consequently, it is consolidating the lots by parcel map and has requested
that the City vacate all of Research Court.
The street improvements proposed for Research Court were not constructed, and
the street was never used for public vehicular traffic. Chapter 4, Article 1 ,
Section 8334 of the State of California Streets and Highways Code states:
The legislative body of a local agency may
summarily vacate any of the following:
a. An excess right-of-way of a street or highway
not required for street or highway purposes.

b. A portion of a street or highway that lies
within property under one ownership and that
does not continue through such ownership or
end touching property of another.
Referring to Exhibit "A" , note that Subsection 8334(b) applies in this case,
as all the lots are under the ownership of SDG&E.
All utility companies have been advised of the proposed vacation and have
responded. Otay Water District has requested that the City reserve the entire
portion of Research Court for its facilities currently in place. The
remaining utility companies have no objections. The legal description of the
proposed vacation includes a reservation of an easement to Otay Water District
covering the entire street right-of-way.
The Planning Department staff has reviewed the proposed vacation and has no
objections.
A transparency is available for Council viewing.
FISCAL IMPACT: None.
