RECOMMENDATION: That Council hold the public hearing and adopt the
resolutions.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
This is a continuation of proceedings initiated on May 27, 1986, and continued
on June 17, 1986, to form an Assessment District for the acquisition of
certain backbone water, sewer, storm drain, and street improvements in the
EastLake development. These improvements are generally located within East
"H" Street, EastLake Drive, Hillside Drive and Lake Shore Drive.
The Engineer' s "Report" contains a description, locator maps, and cost
estimate by units and quantities for each improvement that will be acquired
and included in the Assessment District. Unlike other districts used to build
facilities, this district will purchase facilities already constructed by the
devel oper.
The total cost of these improvements will be $5,279,986.04 as certified and
set forth in the Engineer' s "Report."
At the meeting of June 17, Council questioned how this district fitted into
the policy set by the Public Facilities Financing Report prepared by Wedin
Enterprises, Inc. and approved by Council simultaneously with the EastLake I
Sectional Planning Area (SPA).
The "Wedin Report" is a document which identified proposed financing methods
for each type of public facility needed to support the EastLake development.
Financing methods were selected to ensure that "the City would not expend
existing revenues on capital facilities necessary for the Community of
EastLake I." These financing methods included Community Facilities Districts
(Mello-Roos) , 1913/15 Act Assessment Districts; subdivision exactions, and
other primary and secondary financing techniques. The Wedin Report contains
tables listing estimated improvement costs (by category) and financing methods
for drainage, sewer, water, utilities, roads, parks, open space, schools, fire
station and the transportation center.
In general , the Wedin Report identified a total of $26,405,000 worth of
improvements to be built through subdivision exactions and $20,813,200 of
public facilities which could be financed via Mello-Roos districts or other
methods.
The recommended primary financing methods in the Wedin Report have not
necessarily been followed. Decisions made by the developer, Council , school
district boards and/or the Otay Water District Directors have altered the
facility financing mechanism originally proposed for some facilities. For
instance, the Wedin Report showed that Phase I of the Community Park, fire
station and the transportation center were to be funded via Mello-Roos
districts. Instead, these facilities will now be financed via the payment of
fees by the developer(s).

The assessment district was proposed as a secondary method of financing in the
Wedin Report. This variation, thus, is consistent with the basic purpose of
the report and its recommendation to use assessment districts for public
areawide backbone improvements. No individual subdivision improvements
serving individual lots are included in the district.
Staff and the consultants administrating the district formation proceedings
have looked into the cumulative effect of the various assessment districts on
the property owner' s tax bill . For Council 's information, we have prepared
the attached table showing this effect for a 1300-1400 square foot house in
the $100,000 price range. As this table shows, the total annual levy
(including Mello-Roos for schools, Assessment District 85-2, 86-1 , Maintenance
District, and property taxes) is within 2% of the price of the house.
All prospective purchases of homes in the EastLake Development are provided
with a Notice of Special Taxes and Assessments (sample draft attached) which
lists the type and amount of the special levy. This notice is intended to
assure that the prospective owner is fully aware and agrees to methods chosen
to finance the public facilities serving his/her home.
Through the adoption of the resolutions, Council will :
a. Order appropriate changes or modifications to be proceedings and the
Engineer' s "Report. "
b. Deny any protests received, either oral or written.
c. Approve a contract pertaining to ownership of certain water improvements.
d. Approve the contribution.
e. Accept works of improvement and approve "As-Built Certificate. "
f. Confirm the assessments.
g. Authorize the issuance of bonds to finance the improvements.
h. Accept the proposal for the sale of bonds.
Staff and the consultants will be available at the Council meeting to answer
questions.
FISCAL IMPACT: There will be no cost to the City. The Assessment District
will provide funds for all costs.
