Resolution Directing call for bids for Assessment District No. 85-1 (Las Flores Drive) SUBMITTED BY: Director of Public Works/City Engineer d REVIEWED BY: City Manage9 (4/5ths Vote: Yes No X ) Before staff can proceed with the advertising of bids for construction of Las Flores Drive between Second Avenue and Minot Avenue north of "D" Street, several procedural matters need to be accomplished for the formation of the assessment district. RECOMMENDATION: That Council : 1 . Adopt a map showing the proposed boundaries of a special assessment district designated as Assessment District No. 85-1 (Las Flores Drive) . 2. Make appointments in a special assessment district designated as Assessment District No. 85-1 (Las Flores Drive). 3. Adopt resolution directing call for construction bids for Assessment District No. 85-1 (Las Flores Drive). BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: At the conclusion of the public hearing held on March 13, 1984, in regard to the formation of a special assessment district designated as Assessment District No. 83-1 (Las Flores Drive, et al ) , covering the area between Minot Avenue and Second Avenue north of "E" Street, the City Council decided to abandon the proposed district and directed staff to report back on the various issues brought up at the hearing. / ; Page 2, Item c2/ Meeting Date 6/24/86 The City Council subsequently, on December 18, 1984, approved a report on the improvement of Las Flores Drive and "D" Street between Second Avenue and Minot Avenue north of "E" Street in which Council : 1 . Directed the staff to proceed with the formation of an assessment district covering generally the area shown on the enclosed boundary map for proposed Assessment District 85-1 . Parcels identified as Nos. 29 and 30 have been added to the boundary shown in the previous report. The owner of these two lots is required to improve them through previous Council actions and has indicated his willingness to be included in the proposed district. 2. Directed staff to call up seven deferrals at the same time as the City prepares to advertise for bids on the stage construction for the improvement of Las Flores Drive south of "D" Street and "D" Street from Second Avenue to Minot Avenue. This action has been taken and the deferred improvements installed. 3. Approved the use of an underground storm drain system meeting current City policies to handle the drainage. An underground storm drain was constructed with the stage improvements of Las Flores Drive and "D" Street and will also be constructed with the improvements north of "D" Street. 4. Establish a reimbursement district for those improvements now installed in Las Flores Drive and "D" Street. Staff is in the process of forming this reimbursement district. 5. Directed staff to assist senior citizens in their assessments and deferral payments by the use of a program similar to the State's program regarding the postponement of property taxes. As of this time, staff is unaware of any senior citizens needing such help. 6. Establish a fund of $125,000 to cover construction costs for those properties with deferrals. This fund has been established; however, no loans have been made as of this date. 7. Directed staff to draft a new policy on deferrals for Council consideration. Staff is presently working on a proposed ordinance change covering the guaranteeing of deferred improvements. Page 3, Item Meeting Date / 4/86 The proposed schedule for the Assessment District proceedings and activities for the area north of "D" Street between Second Avenue and Minot Avenue is generally as follows: Date Activity July 8, 1986 City Council adopt resolutions making appointments, adopting proposed boundary map and calling for construction bids. August 13, 1986 Receipt of construction bids. September 2, 1986 City Council to receive and approve preliminary Engineer's report, set public hearing, authorize sale of bonds. October 7, 1986 Public hearing and City Council to consider the following: a. Confirmation of assessments. b. Order improvements. c. Accept proposals for sale of bonds. November 4, 1986 Award construction contract. The three resolutions being approved tonight accomplish the following: 1 . The first resolution adopts a map showing the proposed boundary of the special assessment district designated as Assessment District No. 85-1 (Las Flores Drive). This map shows the boundaries of the proposed assessment district and lands and property to be assessed to pay the cost and expenses of the proposed improvements. The original of said map and one copy thereof, will be filed in the office of the City Clerk. In addition, a certificate shall be endorsed on the original and on at least one copy of said map evidencing the date of adoption of this resolution. 2. The second resolution calls for the making of appointments in the special assessment district designated as Assessment District No. 85-1 (Las Flores Drive) and calls for: a) That the City Engineer is hereby appointed to perform all the duties and functions as the Superintendents of Streets as said duties are specified and designated in the "Municipal Improvement Act of 1913. " b) That the place of recordation of the assessment role and diagram shall be in the office of the Superintendent of Streets. c) That the Star News is hereby designated as the newspaper for all publications as required by law and as necessary for completion of this assessment district. Page 4, Item o<r/ Meeting Date 6/24/86 d) That Bement, Dainwood and Sturgeon is hereby appointed the Assessment Engineer for said proceedings. (The Council by Resolution #11968 approved agreement with Bement, Dainwood and Sturgeon to act as Assessment Engineer. ) e) that James Algert is hereby appointed the Engineer of Work for said proceedings. (The Council by Resolution #11969 approved an agreement with Algert Engineering, Inc. to act as Engineer of Work. ) f) That F. MacKenzie Brown, Inc. , Attorneys at Law, is hereby appointed to act as bond counsel for the purposes of preparing proceedings and issuing and approving opinions attesting to the validity of the proceedings and the enforceability of the bonds. (The Council by Resolution #11967 approved an agreement with F. MacKenzie Brown, Inc. to provide legal services. ) g) That Stone & Youngberg is hereby appointed as underwriter for bonds and said underwriter shall submit upon request a proposal of bid for the sale of bonds and said bonds shall issue pursuant to the terms of the provisions of the "Improvement Act of 1915. " (Stone & Youngberg have been working with staff over the past several years on the formation of an assessment district in this area. Lyman Christopher, Director of Finance, concurs that it would be appropriate to negotiate the sale of bonds. ) h) That the City Council hereby establishes a special improvement fund designated by the name and number of the assessment district and into said fund shall be placed all proceeds from the sale of bonds and cash collections in order to expedite the improvements or acquisition under these proceedings and as authorized by law. Funds from any available source may be transferred into said special fund. Any funds transferred are a loan to the fund and shall be repaid out of the proceeds of the sale of bonds all as required and authorized by law and specifically Section 10210 of the Street and Highway Code of the State of California. 3. The third resolution approves the plans and specifications for the work to be done in the assessment district and calls for bids. FISCAL IMPACT: None.
