HomeMy WebLinkAboutAgenda Statement 1986/07/08 Item 35 COUNCIL AGENDA STATEMENT Item 35 Meeting Date 7/ 8 /86 ITEM TITLE: Resolution 1,--5',/ /- Adopting regulations for candidates for the Consolidated Municipal Election to be held on November 4 , 1986 pertaining to materials submitted to the electorate (4/5ths Vote: Yes Nom) SUBMITTED BY: City C l er _ The resolution sets forth the requirements related to the voluntary Candidates ' Statements and the cost thereof . RECOMMENDATION : Approve the resolution. DISCUSSION : Section 10012 of the State Elections Code permits a local agency to estimate the total cost of printing , handling , translating and mailing of the Candidates ' Statements of Qualifications and require the candidates to pay in advance the pro rata share as a condition of having the statement included in the voter ' s pamphlet . "In the event of over- payment , the City Clerk shall prorate the excess amount among the candidates and refund the excess amount paid within 30 days of the election. " Except for a couple of cases , collecting this money in the past has not been a problem and it would be my recommendation not to require payment in advance . However , if any candidate wishes to deposit the sum estimated by the Registrar of Voters , s/he should be allowed to do so . Because of the length of the ballot and the number of cities consolidating Statementsg t be Voters has s limited V to 200 words . The Registrar' s office no longer publishes Spanish language sample ballots . They do publish a Countywide pamphlet of all propositions and any paid candidates ' statements . Any candidate who wishes to have a statement included in this pamphlet must pay a translation fee of $75 . 00 in addition to the regular cost for English . This pamphlet will be available at the office of the CityeClerk and at all polling places and sent to any voter FISCAL IMPACT: None . The entire cost candidates .
