HomeMy WebLinkAboutReso 1990-15809 RESOLUTION NO. 15809 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING PALOMAR TROLLEY COMMERCIAL CENTER PROJECT EXPANDED PLAN AGREEMENT BETWEEN THE CITY OF CHULA VISTA, THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA AND PACIFIC SCENE, INC., AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the Palomar Trolley Commercial Center Project Expanded P1 an Agreement between the City of Chula Vista, the Redevelopmerit Agency of the City of Chula Vista and Pacific Scene, Inc., a copy of which is on file in the office of the City Clerk. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. BE IT FURTHER RESOLVED that the City Manager or his designee is authorized and directed to develop an Expanded Area Plan ("Expanded Plan") as called for in said agreement, and to do all preliminary work necessarily precedent thereto, including but not limited to: 1. Extending Owner Participation Rights to the extent required and permitted by law. 2. Negotiate a Semi-Exclusive right to negotiate agreement. 3. Negotiate a Disposition and Development Agreement or an Owner's Participation Agreement. 4. Hire appraisers and obtain appraisals. 5. Extending good faith offers to acquire, contingent on Council/Agency approval of the Expanded Plan. 6. Retain such consultants and attorneys as staff finds is necessary, and obtain expertise as staff determines is necessary. 7. Obtain entry necessary to conduct on-site studies, and, if necessary, to obtain court orders for entry. 8. Conduct such environmental studies as is necessary to comply with state and federal law and as will permit the Council to evaluate the environmental consequences. Resolution No. 15809 Page 2 - 9.
