HomeMy WebLinkAboutAgenda Statement 1986/06/17 Item 15a,b COUNCIL AGENDA STATEMENT Item 15 Meeting Date 6/17/86 ITEM TITLE: a) Resolution l r 9i1Approving Final Map for Chula Vista Tract 84-13, Unit No. 1 (56 single family units) b) Resolution Approving Subdivision Improvement Agreement and separate agreements in which developer agrees to participate in an improvement district for Telegraph Canyon Road and in which the developer agrees to provide a maintenance district for the sewer pump station SUBMITTED BY: Director of Public Works/City Engineer REVIEWED BY: City Manager .f 6- 6 ' (4/5ths Vote: Yes No X ) The Final Map for CVT 84-13, Chula Vista Woods, Unit 1 has been reviewed by the Engineering Department and found to be in conformance with the Tentative Map approved by the City Council on November 13, 1984 by Resolution No. 11844. RECOMMENDATION: That Council adopt resolutions a and b as listed in the item title of this report. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The Final Map for CVT 84-13, Unit 1 (which is the legal document creating a total of 56 residential lots and granting easements within the subdivision boundary) is satisfactory to staff and is recommended for Council approval . All conditions of approval placed upon the Tentative Map have been met. The developer has paid all fees and submitted all required documents and bonds. Approval of the Map constitutes acceptance of all drainage, sewer, general utility, and access easements within the subdivision and acceptance on behalf of the public of Foxboro Avenue. All of the remaining streets within the subdivision are private. However, the City is being granted general utility and access easements to maintain facilities within the streets (sewer, storm drain, etc. ) The developer has executed a subdivision improvement agreement and has provided bonds to guarantee construction of the required improvements. The developer has also executed an agreement whereby he or his successors or assigns will participate alternatively in an improvement district for construction of Telegraph Canyon Road should said district be formed or in a facilities benefit agreement for roads only. Page 2, Item 15 Meeting Date 6/17/86 The agreement provides for the developer to deposit $1 ,000 per dwelling unit prior to issuance of building permits to guarantee said participation. The payment of this money, which is essentially a way of participating in the EastLake Facilities Benefit Agreement for roads, is considered by the developer to be an excessive requirement. Our understanding is that his position is based on the difference in conditions which existed at the time of the original approval of the tentative map, and those which exist now. The original tentative map provided for development of 54 conventional single-family lots which would achieve access to Telegraph Canyon Road by way of a connecting street between the easterly subdivision boundary and Medical Center Drive, which was Brandywine Avenue at the time. In July 1983, Council declined to act on a proposed condemnation of right-of-way for that connecting street and the project was forestalled. A new tentative map for the current project was submitted in 1984 and was approved by Council on November 20, 1984. No direct access to Telegraph Canyon is included. The project achieves access from Naples Street by way of a connecting street adjacent to Greg Rogers Park. The right-of-way for that street was purchased at great expense by this developer. A stub street provided as a condition of approval at the northeast corner of the project will provide access to Telegraph Canyon Road at some future date when intervening property is developed. The developer has indicated his belief that the current lack of access to Telegraph Canyon Road and the additional expense of providing an alternative access route should free him from the need of making this deposit. On the other hand, access to Telegraph Canyon Road will ultimately be available, and participation in providing improvements to the circulation system by future owners of the homes will probably not be a fact. The formation of a reimbursement district for Telegraph Canyon Road as envisioned at the time the original tentative map was approved is not likely to happen because of the Facilities Benefit Agreement which came into being with approval of the EastLake development. The condition of approval required participation in the cost of Telegraph Canyon Road and as indicated above, no other form of participation for this developer is likely. At the same time, the developer' s position appears to be, to some extent, justified and staff would recommend not requiring participation in the off-site road. A permanent sewer pump station is being provided in this project because of several physical constraints. The developer has deposited $5,000 to cover the cost of maintaining the pump station for the first year. It is proposed that Page 3, Item 15 Meeting Date 6/17/86 a maintenance district be formed to pay for the ongoing maintenance of the sewer pump station. The developer has agreed to implement formation of the maintenance district. The district should be formed prior to closing of escrow for any dwelling unit within the subdivision. The Final Map for Chula Vista Tract 84-13, Unit 2 has been delayed as a result of grading problems and the inability of the developer and the adjacent property owner to the north (United Enterprises) to agree on an acceptable alignment for a road that would provide an alternate entrance to the subject subdivision. The City Engineer will provide a full report on the problem at the next scheduled meeting of the City Council . A plat is available for Council viewing. FISCAL IMPACT: Not applicable.
