This contract includes the construction of Otay Lakes Road, sewer and water lines, and all appurtenances in the Business Center portion of the EastLake Development. The contract specifies that the inspection of materials and soil testing is to be provided by the City and be paid from the Assessment District No. 85-2 Improvement Fund. We have received a bid from Leighton and Associates in an amount not to exceed $52,800 to perform the soil and material testing associated with the Contract. RECOMMENDATION: That Council adopt Resolution appointing Leighton and Associates as the Geotechnical Consultants for Assessment District 85-2 Contract III-A and appropriating funds to cover the cost of their services. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable DISCUSSION: On May 13, 1986, by a series of Resolutions, the City Council approved a Final Engineer's Report, awarded Contracts III-A and III-B for the construction of improvements in the EastLake Assessment District 85-2 and approved the sale of bonds to finance these improvements. Contract III-A, which is for the construction of water and sewer lines, Otay Lakes Road and all appurtenances in the Business Center portion of the EastLake Development, requires that the soils and material testing needed to inspect these improvements be provided by the City. The Otay Water District, the ultimate owner of the waterlines, agreed to this provision of the Contract and will abide with the City's Geotechnical Consultant choice. Assessment District 85-2 allocated $110,000 to cover the costs of the needed soils and material testing. Page 2, Item 13 Meeting Date 6/17/86 Our Geotechnical Consultant choice for this contract is Leighton and Associates. This firm has performed the majority of the soil/geotechnical investigations in the entire EastLake Development. Their knowledge of the area and accumulated data bank makes them uniquely qualified to be appointed as the firm to perform the soils and material testing for Contract III-A. Leighton and Associates reviewed the scope of work and submitted a fee schedule totaling $52,800 for their services. We have reviewed their proposal and have found it to be reasonable. Thus, we recommend that Leighton and Associates be appointed as the Geotechnical Consultant's to provide material and soils testing for Assessment District 85-2 Contract III-A. FISCAL IMPACT: Leighton and Associates fee of $52,800 for providing soils and material testing for Assessment District 85-2 Contract III-A will be borne by the District. Funds have been allocated for this purpose and will be available from bond proceeds. Therefore, there is not cost to the City. This preliminary cost estimate was prepared using a total job duration of one hundred and fifty (150) calendar days and the Assessment District No. 85-2 Contract III A provided by representatives of the City of Chula Vista. The purpose of our work is two-fold: to see that (1) grading related to realign- ment and construction of the subgrade and base materials of Otay Lakes Road and ( 2) backfilling of the trenches used for sewer pipelines are performed in accordance with the requirements of the City of Chula Vista and our recommenda- tions, as well as existing reports pertaining to the site. We understand these reports are to be provided by the City of Chula Vista. Scope of Services 1 . Any retesting will be noted on Daily Field memos, as well as the hours spent retesting, for your accounting and billing purposes. 3. The results of the field, laboratory, geologic, and engineering evaluations will be presented in an appropriate final report, which will not include a field density test location map, but will summarize the locations of field density tests. We are prepared to commence work immediately with a verbal authorization. For our accounting purposes, please sign one copy of the attached Work Authorization and Agreement form and return it to our office. We estimate that our final report (four copies) will be issued two to three weeks after completion of field work. Cost Estimate Our fee will be based on time and materials in accordance with the attached Fee Schedule. We estimate the cost will be approximately Fifty-Two Thousand Eight Hundred Dollars ($52,800.) . Should any of our assumptions be exceeded, our fees would be charged on a time-and-materials basis. See the attached Table 1 for our assumptions and a breakdown of the estimated costs. It is our understanding that work will be scheduled for eight hours per day. In order to provide the testing and quality control , it may be necessary to work longer. In the event that the construction is separated into dual or more sites, in order to provide proper testing and quality control , an additional temporary soil technician may be necessary. Daily field memos, including additional technician hours worked, will be submitted to your field representative to document our field services. Please review our preliminary cost estimate, especially with respect to scope and assumptions. If you have additional information which would update our scope or assumptions or if you have any other questions, please call at your convenience. We wish to optimize our services to meet your operations and scheduling. If our preliminary cost estimate meets with your approval , you may authorize us to proceed by returning one signed copy of the Work Authorization and Agreement form or your Purchase Order for our accounting files. Consultant agrees to provide professional counsel and technical advice regarding geotechnical conditions, and to use his best professional judgment and perform his services using that degree of care and skill ordinarily exercised, under similar .ircu instances, by reputable soils engineers and/or engineering geologists practicing in southern California. No warranty, expressed or implied, of merchantability or fitness, is made or intended in connection with the work to be performed, or by the furnishing of oral or written reports by Consultant.
