That report has been prepared and the above resolutions approve the report and set the date for a public hearing to consider the spreading of the assessments. The net assessment has increased by 6% over last year. Individual assessments have been similarly modified. (See attached comparison sheet. ) RECOMMENDATION: That the Council adopt resolutions approving the report and declaring its intention to establish the subject lighting and maintenance district, setting the date of June 24, 1986, for the public hearing. Chula Vsta, Caifornia Dated IA-k- (d+-6— - COUNCIL AGENDA STATEMENT Item 13 Meeting Date 6/10/86 ITEM TITLE: Resolution " Approving the negotiated property tax exchange and other agreements relating to the Otay Valley/Palm Avenue reorganization SUBMITTED BY: Director of Finance Director of Planning REVIEWED BY: City Manager j h,. (4/5ths Vote: Yes No X ) On November 5, 1985, the City Council initiated the reorganization of 566 acres of land currently located within the City of San Diego. The property was located east of I-805 and south of the Otay River. Subsequently on March 18, 1986, the Council amended its previous application to only include two separate parcels totaling 242 acres. The revision was due to property owner opposition. A property tax exchange is now required before LAFCO can act on the reorganization. RECOMMENDATION: That Council adopt the resolution. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: A number of actions have occurred with respect to this reorganization thus far. The General Plan Designation and Prezoning have been established. The City of San Diego has consented to the detachment. LAFCO Commission action is pending July 7, 1986, once their staff is in receipt of property tax resolutions from each city, San Diego and Chula Vista. The City of San Diego is expected to adopt a similar resolution on June 10, 1986. This is the final action required to move this item forward to a public hearing before LAFCO. The total property tax is proposed to revert to the City of Chula Vista. In addition, the resolution calls for an agreement between the City of San Diego and the City of Chula Vista. The subject of the agreement would be three conditions. First, a condition to indemnify the City of San Diego for any taxes which might accrue because certain water and sewer lines are now in the City of Chula Vista instead of the City of San Diego. Presently, there are no such taxes on such public facilities regardless of the jurisdiction. The issue is moot unless the State Constitution should be amended in the future. Nonetheless, the City of San Diego wants the protection language included at this point. Page 2, Item 13 Meeting Date 6/10/86 A second condition calls for a commitment by the property owners in question to participate in the funding of improvements contained in the City of San Diego' s Otay Mesa Public Facilities Financing Plan. The properties are currently part of the overall Otay Mesa assessment district financing proposal . San Diego feels the properties should remain a part of the financing package and responsible for their fair share commitment. We agree. Finally, a condition is included giving San Diego unrestricted access to their utility easements in place in the area. This is not perceived as a problem. FISCAL IMPACT: A total of $9,417 will be reallocated to the City of Chula Vista. The annual tax increment formerly received by the detaching City is being reallocated to the annexing City of Chula Vista.
