(4/5ths Vote: Yes No X ) Chula Vista Investment Company, owner of property located in the Chula Vista Midbayfront Subarea of the Local Coastal Zone, has obtained the rights to a large amount of fill material . Since future development within the Midbayfront will require an extraordinary amount of imported fill , the applicant wishes to take advantage of available material and stockpile it on their site. A notice of Adequate Prior Environmental Review has been issued for this project and the City Engineer is currently reviewing the proposed stockpile plan. RECOMMENDATION: That the City Council conduct a public and consider the attached resolution, and findings therein, finding hearin that the proposed stockpiling of fill material in the Midbayfront is consistent with and adequate to carry out the policies of the Certified Chula Vista Bayfront Local Coastal Program and issue a Coastal Development Permit for said proposal subject to the condition listed in attachment A of the attached resolution. BOARDS/COMMISSIONS RECOMMENDATION: Not Applicable DISCUSSION: The applicant proposes to place approximately 100,000 cubic yards of imed earth on an area of about 30 acres located west of Bay Boulevard between r"D" and "F" Streets on the Chula Vista Bayfront. The proposal is technically called an uncontrolled fill since it is a temporary stockpiling of fill , however, erosion control , contouring, and landscaping will be required as part of the project. Import will be placed just west of the existing agricultural building currently located on the Midbayfront. Fill will be distributed and contoured in accordance with the City's Certified LCP. The material will begin being laid at the existing 15 foot elevation on the eastern boundary of the project and graded toward the west with a finished grade of 10 feet along I Page 2, Item 5 Meeting Date 5727786 the western boundary. The finished stockpile height will be at or above the 10 foot elevation (100 year flood level ) and drainage will conform to the Land Form and Drainage Plan depicted in the Bayfront Specific Plan. As proposed, the height of the fill material is at a maximum depth of 5 feet, averaging 3 to 4 feet. The highest point of the work being undertaken will be located at the southwest corner of the stockpile where top-of-berm for diking purposes will be at 13.5 feet, approximately 7.5 feet above natural grade. Erosion control devices have been developed and are incorporated into the proposal. Prior to the placement of the fill , "silt stop" sediment control fencing (or equal ) will be installed per specification. It will be located 10 feet from the toe of the stockpile berm. This provision will avoid siltation to the west. Finish grading and planting of all slopes will be accomplished prior to November 1 . In accordance with the regulations within the Certified LCP, grading for any purpose is prohibited between November 1 and April 1 . All areas that will be disturbed by the grading will be planted with native grasses prior to the November 1 date. Existing Midbayfront drainage will not be redirected due to the project. The new grades will continue to slope from east to west. The area of the Midbayfront which drains naturally to the southwest and into the existing "remnant" marsh will not be disturbed. The northwest corner of the stockpile will be contoured away from Vener marsh. Also, the fill will be diked along the north, west, and south edges where the fill is above the existing natural grade. Seepage from the stone outlet sediment trap will be filtered through the silt fence and will be discharged to the bay. The City Engineering Department will require calculations which will be evaluated to ensure that no significant increase in run-off will result from the project. And, that the erosion control methods proposed are adequate to prevent erosion and siltation. Based on the following findings, the proposed stockpile, subject to conditions listed in Exhibit A of the attached resolution has been found to be consistent with the policies of the Certified Chula Vista Bayfront Local Coastal Program: 1 . As proposed, the project will conform to the grading concept for imported fill that is contained in the Certified LCP. Existing drainage patterns will not be disrupted by the fill material and the contours planned for the stockpile will continue to direct surface flow westward to the bay. 2. The project site is currently undeveloped and does not provide recreational facilities or access to recreational facilities. Therefore, the proposal , if undertaken, will not conflict or impact recreational or visitor-serving facilities. 3. The project will not cause interference with traffic circulation within the Chula Vista Coastal Zone since there are no existing public roadways on or adjacent to the project site. Furthermore, the access to Gunpowder Point and the Nature Center site will not be affected by the proposal . Page 3, Item 5 Meeting Date-57277$5 4. Drainage patterns for and adjacent to the proposed fill have been designed to avoid changes in existing run-off patterns. Also, a dike, sediment trap, and sediment control fencing have been incorporated into the project to preclude siltation and erosion, therefore, the proposal will not affect area wetlands. 5. The Statewide and Regional Interpretive Guidelines have been reviewed and the proposed development has been found to be in conformance with Public Access and Public Recreational policies of Chapter 3 of the Public Resources Code. WPC 2278H f C;.y Chula \6sLa, Dated Chula Vista Investment Company Mid-Bayfront Stockpile Plan CONDITIONS OF APPROVAL 1 . A grading plan, "plan for uncontrolled fill ," must be approved by the City and in accordance with the certified Chula Vista LCP before the Chula Vista Investment Company Mid-Bayfront Stockpile Coastal Development permit is valid. 2. Calculations documenting the hydrologic characteristics of the proposed stockpile area must be provided to the City and approved by the City Engineer. These calculations must show how the stone outlet sediment trap will act to prevent ponding which could cause a vector control problem. 3. The core of the stone outlet sediment trap must be composed of sand (or some other inert material ) to ensure that introduction of non-native species such as straw or hay from seeds in the bales is prevented. 4. Soil samples from the fill source must be taken and analyzed so that a licensed landscape architect can provide advice as to which native plant species could be used to provide the required vegetative coverage. Soils information and recommended plant materials shall be included on the revised plans. 5. The soils analyses must also be presented to the City's Landscape Architect for review. 6. Any changes in the landscape notes recommended by the project landscape architect and approved by the City Landscape Architect must be incorporated into the revised grading plan. 7. In the event that the fill soils do not come from the Convention Center site, further soils analyses, and administrative review of any proposed changes in plant materials by the City Landscape Architect, will be required. A new approved plan will not be required for these administrative changes.
