Resolution Accepting grants of easements for sewer and storm drain purposes SUBMITTED BY: Director of Public Works/City Engineer ' REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) RECOMMENDATION: That Council adopt the resolutions listed in the title hereto. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: On May 6, 1986, the City Council approved the condemnation of certain parcels of land necessary for the improvement of Otay Lakes Road and Lane Avenue, and associated drainage easements, and a sewer easement necessary to extend the sewer main to serve the EastLake Business Center. The owner of the subject parcels, United Enterprises Inc. , has since executed the documents granting the easements for sewer, storm drain, and street purposes. The street easements, storm drain easements and sewer easement discussed above are all within County jurisdiction, creating a question of liability. EastLake Development Company has executed an agreement in which they agree to indemnify the City from liability, and has provided an insurance policy with the City as beneficiary to protect the City.
