HomeMy WebLinkAboutAgenda Statement 1986/09/23 Item 19 COUNCIL AGENDA STATEMENT Item 19 Meeting Date 9/23/86 ITEM TITLE: a) Report: Proposed Open Space Maintenance District No. 15, Bonita Haciendas b) Resolution 1a1S Approving preliminary report and declaring intention to form Open Space Maintenance District No. 15 SUBMITTED BY: Director of Public Works/City Engineer 9/efj REVIEWED BY: City Manages (4/5ths Vote: Yes No X ) The purpose of this report is to provide the necessary background information to enable the City Council to initiate formation of an open space maintenance district within Bonita Haciendas Subdivision. The boundaries of the proposed district are shown on Attachment "A." Specific issues examined in this report are the requirements for the proposed district and conformance by the petitioner with the criteria contained in the Municipal Code for establishing open space maintenance districts. RECOMMENDATION: That the City Council : 1 . Adopt a resolution declaring the Council ' s intention to form the proposed district in accordance with Section 17.08.160 of the Municipal Code. 2. Set October14 , 1986, at 7:00 p.m. in the Council Chambers as the date and time for a public hearing to consider the proposed formation of Open Space Maintenance District No. 15. 3. Direct the City Clerk to advertise the public hearing and mail notices of the hearing to affected persons in accordance with Sections 17.08.180 and 17.08.190 of the Municipal Code and the notification requirements of the laws of the State of California. BOARDS/COMMISSIONS RECOMMENDATION: The Planning Commission took action to recommend approval of the Tentative Map for Bonita Haciendas on May 10, 1978. Such approval included the designated open space areas shown on the tentative map. On September 17, 1986, the Planning Commission recommended the formation of an open space maintenance district for Bonita Haciendas Subdivision in Resolution PCS 78-2A. DISCUSSION: The Tentative and Final Subdivision Maps for Bonita Haciendas were approved by the City Council in 1978 and 1979, respectively, with the understanding that the four open space lots shown would be private and would be maintained by the Homeowners' Association. McMillin Development, Inc. , the current owner of all lots in the Bonita Haciendas Subdivision, has submitted letters of petition on Page 2, Item 19 Meeting Date 9/23/86 June 12, 1986, and August 19, 1986, requesting the formation of an open space maintenance district. McMillin Development, Inc. , has proposed that Lots "A" , "B" and "D" as shown on the Final Subdivision Map of Bonita Haciendas be public open space lots and Lot "C" would be a private mini-park maintained by the Homeowners' Association and has submitted a grant deed to the City conveying ownership of Lots "A" , "B" and "D" to the City. Staff recommends that the City Council accept title to these three lots for open space purposes concurrent with the resolution forming the Open Space District. All of the proposed open space lots conform to the criteria contained in Section 17.08.020C of the Municipal Code. Should the Open Space District be formed, the three lots will not be maintained by a homeowners' association as required by the Municipal Code. The entire Bonita Haciendas Subdivision will comprise the District. There will be a total of 29.9 acres within the proposed District boundary. The proposed total of all open space areas to be maintained is about 5.35 acres, consisting of Lots A, B and D. Lots B and D will be maintained as natural open space. All landscaping and irrigation has been installed in Lot A and is under the contractor's one year guarantee at the present time. There are 57 benefiting properties (57 EDU) on the assessment rolls within the proposed district at this time. The estimated annual maintenance cost to be assessed each new EDU is approximately $114. Attachment "B" indicates the allocation of costs for each lot within the district. Lot numbers are those shown on Map No. 9494, the Final Subdivision Map for Bonita Haciendas. The petitioner (McMillin Development, Inc. ) is the present owner of all the properties to be assessed. The responsibility for paying the open space maintenance assessment will be conveyed with each of the benefiting prtopertties as those properties are sold. A map showing the proposed district, he open space areas and the benefiting properties is attached (Attachment "A"). The review of plans and inspection of landscaping work are being coordinated with the Landscape Architect and Parks and Recreation Department. FISCAL IMPACT: None.
