HomeMy WebLinkAboutAgenda Statement 1986/09/16 Item COUNCIL AGENDA STATEMENT Meeting Date 9/16/86 Unanimous Consent Item ITEM TITLE: Resolution /a 7aaCalling and Giving notice of the holding of a Special Mail Ballot Election to be held in said City on Tuesday, December 16 , 1986 for the purpose of submitting to the qualified electors of Chula Vista a vote on the Rent Control Initiative SUBMITTED BY: City Clerk (4/5ths Vote: Yes No X ) On Tuesday, August 26, 1986 petitions were filed in this office by Reverend Robert Flaugher for a Rent Control Initiative . The 437 petitions were purported to contain 11 , 318 signatures of registered voters in the City of Chula Vista . On August 26, 1986, the City Clerk submitted the petitions to the Registrar of Voters for certification of the signatures . A sufficient amount necessary for a special election has been verified. RECOMMENDATION: Approve the resolution ordering the Special Mail Ballot Election on December 16 , 1986 . DISCUSSION: On February 2 , 1986 , the Registrar of Voters certified to the Secretary of State that there were 45, 034 registered voters in Chula Vista . Although this figure did not include the Montgomery area, it was nevertheless , the figure which had to be used by the proponents of the Initiative . To qualify for a Special Election, they had to obtain 6, 756 signatures of registered voters . Because the petitions contained a number far greater than that, I ordered a 5% random sampling of the petitions . Election Code 6555. 5 allows that if the number of signatures affixed to a petition . . . " is 100 or more, the clerk may use a random sampling technique for verification of the signatures . . .Upon completion of the verification of signatures in the sample, the percentage of signatures which are valid shall be applied and projected to the total number of signatures submitted. " Page 2 Meeting Date 9/16/86 Unanimous Consent Item Verification of the signatures revealed that of the 559 signatures checked ( 5% of 11 ,183 ) , 439 were found to be valid; therefore , the petitions , as submitted, do qualify for a Special Election . The City Council , upon receiving this verification from the City Clerk shall either : (a) introduce the ordinance without alteration at the regular meeting at which it is presented and adopt the ordinance within 10 days after it is presented; or (b) immediately order a special election to be held not less than 88 nor more than 103 days after the date of the order at which the ordinance without alteration shall be submitted to a vote of the voters of the City (between December 13-29 , 1986 ) . Although the Elections Code gives the City Clerk 30 days in which to verify the signatures , the staff of the Registrar of Voters ' office completed the check in 8 days . Therefore, based on this time schedule , the following will now occur : September 16 - City Council calls for a Special Election 21 - Publication calling the Special Election and for setting the deadline arguments 30 - Deadline for submitting arguments November 17 - Close of registration for this election December 1 - Sample ballots are mailed December 16 - Election Day As in the past, the Registrar of Voters will conduct the election with the City Clerk handling all of the legal work associated with same . FISCAL IMPACT: The Registrar of Voters estimates the cost of a mail ballot election to be approximately 65% of a regular election .
