HomeMy WebLinkAboutAgenda Statement 1986/09/16 Item 24 COUNCIL AGENDA STATEMENT Item 24 Meeting Date 9/16/86 ITEM TITLE: RESOLUTION/ 7 Z7 Approving Variance Granted by the Board of Appeals and Advisors regarding Swimming Pool Fence at 4080 Bermuda Dunes Place SUBMITTED BY: Acting Director of Building and Housingv P6 (4/5ths Vote: Yes No x ) REVIEWED BY: City Manager' On September 8, 1986 the Board of Appeals and Advisors heard an appeal presented by the property owner at 4080 Bermuda Dunes Place for an exemption from the 5-foot high City pool fencing requirement. Pursuant to Section 15.48.060 of the Municipal Code, the recommenda- tion of the Board is forwarded to Council for review and approval . RECOMMENDATION: That Council accept the Board's findings and recommendation for approval of the existing 32-foot high enclosure for the installation of a new spa. BOARDS/COMMISSIONS RECOMMENDATION: Acceptance of the Board' s findings and recommendation for approval of the appeal . DISCUSSION: A swimming pool was installed in 1965 on this property abutting the Municipal Golf Course in a wedge shaped lot on two sides. At the time of installation the fence measuring 3 feet in height above the lot pad and 32 to 4 feet above the golf course grade was legal . Sometime in the early 1970' s, the required fencing height was raised to 5 feet. This has not been enforced retroactively. The property owner now wishes to have a spa installed in the pool area. The addition of the spa could necessitate the erection of a 5-foot high fence around the spa, leaving this pool legally protected by the existing 32-foot high fence. CC&R's imposed upon the Bonita Verde development prohibit fences abutting the golf course in excess of 3 feet in height. The rear and sides of the lot are well protected from toddlers by the inaccessibility of the golf course and the fence and dense shrubbery screening the pool . The pool area is pro- tected from neighborhood children by a 5-foot high fence and gate with self-closing and self-latching devices on both sides of the house. In staff' s opinion, the present fencing will adequately protect the pool-spa area. Neither the pool nor the proposed spa are attractive nuisances since they cannot be seen from any- where off of the lot. The Board unanimously approved the exemption from the 5-foot high fencing requirements and recommends Council 's acceptance of the existing 32-foot high fence as adequate protection for the installation of the new spa. Pool fencing appeal decisions are the only Board of Appeal 's actions required by City Ordinance to be reviewed by Council . If Council considers this review process an unnecessar duplication of time and effort, please so -indicate so that necessary changes can be prepared for consideration.
