ITEM TITLE: Resolution I77 - 5 Accepting public improvements, Eucalyptus
Ridge Subdivision

The ADMA Company, Inc. by their letter dated August 27, 1986, is requesting
acceptance of the public improvements for Eucalyptus Ridge Subdivision. They
are also requesting a waiver of the requirement for posting a 15% surety bond
to guarantee the public improvements for a year after acceptance by the
Council . The improvement agreement was approved by Resolution 11474 dated
November 22, 1983.
RECOMMENDATION: That Council adopt resolution accepting public improvements
and declare that the intent of the one-year bond for material and workmanship
has been fulfilled due to the time lag between completion of construction and
this acceptance, and that posting of the bond is not required.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Eucalyptus Ridge Subdivision is a condominium project constructed with private
streets and driveways.
The public improvements which were constructed as a condition of approval for
the final subdivision map consisted of sewers, storm drains, two driveway
approaches and widening of the existing sidewalk on East "H" Street an
additional 2.5 feet. The subdivision improvement bond is $44,200. The work
was completed in April of 1985.
It is normal procedure and required by Section 18.16.330 of the City Code that
the developer post a 15% maintenance bond guaranteeing the public improvements
for one year after Council acceptance. The ADMA Co. , Inc. has requested that
this requirement be waived.
A final inspection was made on August 14, 1986, of the public improvements and
no defects due to materials and workmanship were discovered. Since no defects
have occurred since April of 1985 which represents a year and a half, staff
feels that the purpose of posting a guarantee bond has been satisfied.
Granting of ADMA Co. , Inc. ' s request would not be precedent setting because
Council has waived this requirement in the past in similar situations, i .e. ,
Telegraph Canyon Terrace.
ADMA Company, Inc. would need to submit a bond in the amount of $6,675.00
should the City Council require that a 15% guarantee bond be posted prior to
acceptance of the improvements.
FISCAL IMPACT: The City will assume maintenance of the public improvements
after acceptance.

ADMA CO. , INC. requests that the City of Chula Vista waive the 15% guarantee
requirements on Bond #399089. Said waiver request is predicated upon the
fact that all improvements at Eucalyptus Ridge have existed for over a year
and there is no current damage. Also, all bonding/city requirements have
been met.
