HomeMy WebLinkAboutAgenda Statement 1986/09/16 Item 13 COUNCIL AGENDA STATEMENT Item 13 Meeting Date 9/16/86 ITEM TITLE: Resolution /.z 2/L/ Approving agreement between the City of Chula Vista and the County of San Diego authorizing the transfer of Road Funds equivalent to Montgomery Area SB 300 Pi/ funds and appropriating the funds thereof SUBMITTED BY: Director of Public Works/Engineering REVIEWED BY: City Manage (4/5ths Vote: Yes X No ) In 1985, the State Legislature added Sections 2126 and 2127 to the Streets and Highways Code (SB 300) and appropriated $215,000,000 from the State General Fund to counties and cities for street and highway maintenance and/or reconstruction. $125,000,000 was appropriated for FY 85-86 and $90,000,000 for FY 86-87 with 55 percent going to the cities and 45 percent to the counti es. The City has received its share of the SB 300 appropriations for FY 85-86 ($623,098) and has negotiated an agreement with the County of San Diego for the transfer of the SB 300 appropriation the County received attributable to the Montgomery Area. Per this agreement, the City will receive $12,681 .58 in Road Funds which represent one-half of the funds the County received attributable to the Montgomery Area since the annexation became effective at the midpoint of FY 1985-86. RECOMMENDATION: That Council adopt resolution approving agreement between the City of Chula Vista and the County of San Diego authorizing the transfer of Road Funds equivalent to Montgomery Area SB 300 funds and appropriating the funds thereof. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Senate Bill 300 appropriated funds to counties and cities for street and highway maintenance and/or reconstruction purposes. The City has received its share of the FY 85-86 appropriations and has negotiated an agreement with the County whereby they agree to transfer the share of their SB 300 allocation attributable to the Montgomery Area. The $6,341 was computed by multiplying the County' s share of SB300 (based upon maintained road miles) funds times the ratio of maintained miles in Montgomery to the total maintained miles in the County Road System. Half of this amount represents the 6 months that the Montgomery area was annexed to the City for FY 85-86. The agreement negotiated with the County to transfer SB 300 allocations generated from the Montgomery Area to the City is considered to be equitable for both parties. The County will transfer $12,681 .58 in Road Funds which will supplement the $623,098 we have already received from the State. Engineering staff, therefore, recommends that the City Council approve the agreement. It should be noted that the County is under no statutory obligation to provide SB 300 funds due to the annexation of the Montgomery Area but is doing so in the interest of fairness. FISCAL IMPACT: City will receive $12,681 .58 in Road Funds from the County of San Diego which is considered to be the equitable amount they received attributable to the Montgomery Area. Walsh, Deputy Director (Acting) Program Development/Public Services (0332) SUBJECT: Payment to City of Chula Vista for Montgomery Area SB300 Funds On October 21, 1986, the Board of Supervisors executed the attached agreement between the County of San Diego and the City of Chula Vista regarding SB300 funds (County Contract No. 23289E). The agreement authorizes the County to transfer to the City $12,681.58 in Road Funds equivalent to the portion of the County's SB300 funds attributable to Montgomery. Please issue a check in the amount of $12,681.58 for payment to the City in accordance-with the agreement.
