FOR THE PROVISION OF BIOLOGICAL MONITORII�'G SERVICES DURING THE CONSTRUCTION .Si\'D SUBSEQUENT FIVE- YEAR MAII`iTENANCE PERIOD FOR BOI�'ITA CANYON ENVIRONMENTAL RESTORATION AIvD A4ITIGATION PROJECT �VHEREAS. on Aueust 17. 2010. in accordance ���ith Resolution No. 2010-212, the Cit�• Council established a new Capital Impro��ement Project for Bonita Canyon Repairs. project (DR- 189); and �1'HEREAS. on November 9. 2010. in accordance ti�ith Resolution No. ZO10-263. the Citv Council appro��ed an agreement ben��een the City of Chula Vista and the Rick Engineerino Compan}� and Helix Environmental Plannino (`RH Team") for professional services for preparing plans and specifications for the Bonita Canvon Repair Project; and VdHEREAS. on Mazch 13. 2012. in accordance ���ith Resolution No. 2012-0�1. the Cit�� Council appropriated ��04,000 from the General Fund Reser��e for Fiscal 1'ear 2012. to the existine Capital Improvement Project DR189; for the construction of the Bonita Canyon repairs, environmental permittine fees, and for certain additional consultant services in accordance ��ith Article I of the Agreement ���ith RH Team; and �'HEREAS. on March li. 2012. in accordance �vith Resolution No. 2012-041, the Cit� Council appropriated an additional S�14:000 to DR189 for Bonita Canvon environmental miti�ation in the Fiscal Year 2012/20li Capital Improvement Budoet: and ��'l-IEREAS, ��fiile processine plans for repairine the gabion structure «�ith the Resource Agencies, Staff applied for an emereenc}� Reeional General Permit No. 63 permit (RGP63) from the Arm�� Corps of Eneineers due the �vinerabilin of the condition of the gabion structure and the threats of major storms; and WHEREAS, on December 31. 2012, the Armv Corps of Eneineers (ACOE) eranted the Citv a RGP6.i permit to reinforce the eabion structure; and \�'HEREAS, on January 4, ZOL.i, upon obtainine City 1�4anaser's appro��al and upon solicitine three informal bids from contractors, staff retained Cass Construction; Inc. to perform Bonita Can}�on Emersenc�� Repair in accordance N•ith pro��isions in Section 1009 of the Cit� Charter. and � Resolution No. 201�-026 Pase No. ? WHEREAS, on Marc6 27, 2013. Cass Construction. Inc. completed the emergency repair work, and as a result of completing the emergency work; the potential threat of injury and propem� damage �+�as a��ened; and WHEREAS; on .lul}� 22, 2014, the ACOE issued an approval letter for the Habitat Mitigation and Monitoring Plan (HMMP), �vhere that HMMP approval a11oN�ed RH Team to complete the design and the bid package for the remaining environmental restoration and mitieation project; and WHEREAS. in accordance ti�ith provisions in Section ]009 of the City Charter, on December 30, 2014. Chula Vista staff advertised and solicited bids from contractors for Bonita Canyon Environmental Restoration and Mitigation project that implements the wetland and upland environmental mitigation, said contract also includes a 5-year maintenance period as required by the approved HMMP; and WHEREAS, the lowest bid for said contract was submitted by Natures Image, Inc. (Contractor License No. 720�l.i) in the amount of$244,602.10; and WHEREAS. in addition. the HMMP requires that the City retain a second part}� to provide biological monitoring during the installation of the restoration and mitigation as �vell as the �-year maintenance period afrer installation; and WHEREAS; since Helix Em�ironmental Planning (Helix) is very familiar �vith all aspect of this project, is already under contract with the City for finalizing the HMMP, and has established a working relationship with the ACOE, staff recommends that City Council N�aive the standard competitive selection process as impractical and in the City's best interest, and on sole source basis retain Heli� to provide the biological monitoring services; and WHEREAS, staff and Heli� negotiated the contract amount for such services and arrived at a total contract price of$95,900; and WHEREAS, staff believes Helix's requested amount is fair and reasonable and therefore recommends retaining Helix for such work. NOW, THEREFORE, BE ]T RESOLVED, by the City Council of the City of Chula Vista that it �vaive the competitive selection process pursuant to Chula Vista Municipal Code section 2.�6.070(B)(3); accept Helix '`Letter Agreemenbproposal to provide Biological Consulting Sen�ices for Bonita Can}�on Environmental Restoration and Mitigation Project'; approve an agreement, in the form presented, with such minor modifications as may be required or approved by the City Attorney, �vith Helix in the amount of$95,900, including contingenc}�, for the provision of biological monitoring for Bonita Canyon Em�ironmental Restoration and Mitigation project (DR200); and authorize and direct the Mayor to execute same.
