RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
AUTHORIZING LIBRARY STAFF TO PREPARE AN APPLICATION FOR
THE LIBRARY BOND ACT FUNDS, APPROVING THE ORANGE AND
FOURTH AVENUE PARK SITE FOR THE PROPOSED LIBRARY,
AUTHORIZING STAFF TO NEGOTIATE A CONTRACT WITH
WHEELER-WYMER-BLACKMAN ASSOCIATES FOR ARCHITECTURAL
SERVICES AND WAIVE THE BIDDING PROCESS
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, the Library Bond Act provides $75,000,000 to local jurisdictions
to assist in public library construction; and
WHEREAS, on July 25, 1990, the Council was informed that the Chula Vista
Public Library filed a "Notice of Intent to Apply" for funds available from
the Bond Act; and
WHEREAS, said Notice was non-binding and briefly outlined a proposed
35,000 sq. ft. Library in the Montgomery/Otay Planning Area of south Chula
Vista; and
WHEREAS, approximately 200 "Notices of Intent to Apply" were sent to the
State Library resulting in requests for $400,000,00 in state funds; and
WHEREAS, it is necessary to prepare a pre-application and an application
for California Library Construction and Renovation Bond Act funds; and
WHEREAS, the Bond Act regulations require verification that a California
licensed architect provide the construction budget estimate and conceptual
plans; and
WHEREAS, the City's normal procedure would be to solicit and evaluate
proposals for architectural services, however, because of the short time frame
to meet the application deadline, staff requests authorization to negotiate a
contract with Wheeler-Wimer-Blackman Associates for preliminary design
services and waive the bidding process; and
WHEREAS, funds in the amount of $114,500 need to be appropriated for the
required professional design services for the application submission; and
WHEREAS, the Library Board of Trustees recommended the pre-application
and application for funds to build a library in South Chula Vista; and
WHEREAS, the Library Board of Trustees, the Montgomery Planning Committee
and the Parks and Recreation Commission supported using the proposed Orange
and Fourth Avenue park site for this application.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby authorize library staff to prepare a pre-application and an
application for the California Library Construction and Renovation Bond Act
funds.
BE IT FURTHER RESOLVED that the Orange and Fourth Avenue Park site is
hereby approved for the library for this application process subject to the
unfettered discretion of the City to review the environmental consequences and
reject the site on the basis of said review, or condition its development to
mitigate any environmental consequences.
BE IT FURTHER RESOLVED that staff is hereby authorized to negotiate a
contract with Wheeler-Wymer-Blackman Associates for professional design
services and architectural services, which contract shall require a Scope of
Work that takes into consideration siting of the structures and facilities in
light of the electromagnetic radiation; incorporates a flexible design and
layout that will permit the City to utilize parts of the facility for business
ventures around and within the proposed improvements, and will consider
improvements in phases in the event that the grant application should be
denied.
BE IT FURTHER RESOLVED that the City Council does hereby waive the normal
bidding process due to the time constraints in meeting the application
deadline pursuant to Chula Vista Municipal Code Section 2.56.170.
