National Avenue Associates, lessee of the property located southwest of the
intersection of Fifth Avenue and "B" Street, would like to accept fill from
the Corps/Caltrans Highway 54 project. Since future development on the site
will require a large amount of imported fill to bring the property up to the
level of the adjacent roadways, the applicant would like to take advantage of
the available fill material .

RECOMMENDATION: That the City Council conduct a public hearing the consider

Vista Local Coastal Program and issue a Coastal Development Permit for said

Erosion control devices are incorporated into the proposal . Prior to the
placement of the fill , "silt stop" sediment control fencing (or equal ) will be
installed per specification. It will be located 10 feet from the toe of the
fill . This provision will avoid siltation in the Sweetwater River Channel .
Finish grading and planting of all slopes will be accomplished prior to
November 1 . In accordance with the regulations within the Certified LCP,
grading for any purpose, including stockpiling of fill , is prohibited between
November 1 and April 1 . All areas that will be disturbed by the grading will
be planted with native vegetation prior to the November 1 date.
Based on the following findings, the proposed controlled fill , subject to
