RECOMMENDATION: That Council : 1 . Conduct the public hearing on the formation of the conversion district. 2. Adopt a resolution forming the district and authorizing the use of $255 of allocation funds to subsidize three single-family residential service lateral conversions. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The Underground Utility Advisory Committee, consisting of representatives of SDG&E, Pacific Bell , Cox Cable TV, and the City agreed to propose to Council the formation of a district to convert the overhead facilities along Fourth Avenue from Orange Avenue to Main Street. This portion of Fourth Avenue is located in the recently annexed Montgomery area. The County of San Diego was working on the formation of this district prior to the annexation and would have established it this year had the area remained under their jurisdiction. (It should be noted that south of Orange Avenue, Fourth Avenue is known as Hermosa Avenue. ) This district was the last of the five the County planned for the Montgomery area. For this reason, County staff obtained Board of Supervisor approval to transfer $600,000 (the estimated project cost) of its SDG&E allocation funds to Chula Vista so that we may proceed with the project. Page 2, Item 18 Meeting Date 8/12/86 We recommend the formation of this conversion district because: 1 . This segment of Fourth Avenue carries an average daily traffic of 6500. 2. All work will be done within the Fourth Avenue right-of-way. 3. County allocation funds have been transferred to Chula Vista to cover the conversion costs. 4. This proposed district will complete the County's planned conversion program for this area. Section 15.32.130 of the Chula Vista Municipal Code requires that City Council hold a public hearing to determine whether the public health, safety and general welfare requires the undergrounding of existing overhead utilities within designated areas of the City and to give the persons the opportunity to speak in favor or against the formation of a proposed district to underground utilities. The purpose of forming the district is to require property owners to change their electrical wiring to receive underground electrical service. The service lateral conversion is a cost to be borne by the property owner and generally ranges between $300 and $1 ,000. To ease the burden on the property owner, Council adopted a policy (No. 585-1 ) on April 2, 1985, by Resolution No. 11977, on the use of utility funds to subsidize the conversion of private service laterals. Per this policy, the use of allocation funds is limited to single family residential properties and is not to exceed the estimated cost of trenching and conduit installation for up to 100 feet of the private service lateral . On July 18, 1986, staff informed Council that: (1 ) there were two developed single-family properties located within the proposed district eligible for this subsidy and (2) we would return with a recommended subsidy for each property at the public hearing. Subsequent to a field meeting with representatives from SDG&E Co. , it was determined that a third property should also receive the subsidy. This property is located at the southwest corner of Montgomery Street and Fourth Avenue (Parcel No. 623-171-11 ). We therefore recommend that this parcel also receive the conversion subsidy. The property owners are responsible to provide the underground service and the utility companies will reimburse the owner an amount (set by Council ) which only covers about 1/3 of the owner' s total cost. The reimbursable amounts to the property owners will be paid by the utility companies through the City after the project is completed. A submission of the resolution to the City Council will occur after the utility companies have agreed on a schedule for the project. A transparency is available showing the proposed boundary of the district. FISCAL IMPACT: The cost to underground utilities along Fourth Avenue (Hermosa Avenue) from Orange Avenue to Main Street is estimated to be about $600,000. The County of San Diego has transferred $600,000 of their SDG&E allocation funds to the City to cover the project's estimated cost. A $255 subsidy to three single-family property owners within this district will be made from allocated funds paid from the utility companies' conversion budget.
