RECOMMENDATION: That the City Council adopt a resolution accepting the
subject dedications and direct the City Clerk to forward them to the County
Recorder' s office.

DISCUSSION:
In July 1985, "G" and Church Limited applied for a permit to construct a
36-unit apartment building at 423 Church Avenue known as Oak Terrace.
A grading permit was required under Ordinance 1797 of the City Code in which
the requirement to construct storm drainage improvements resulted in the need
for a right-of-way and drainage easements being granted to the City for the
right of ingress, egress, and to construct, maintain, operate, replace,
remove, or enlarge a drain sewer and appurtenant structures.
These easements were granted by:
1 . John and Rebecca Hernandez as trustees of the "the Hernandez Family
Trust," and affects the property at 264 "G" Street. Said easement is a
triangular area situated at the southeast corner of the above mentioned
address and is for the purpose of granting u o City of an
easement and right-of-way for the right to construct and maintain a
drainage sewer.
2. Laura Susana Smith and affects the property at 248 and 250 "G" Street.
This easement is a rectangular area 18x26 located 25 feet from the
southwest corner City of above and right-of-way purpose or the
granting unto o the Y

3. Tim J. Connole and affects the property at 423 Church Avenue. The
easement is a strip of land being adjacent and parallel with the northerly

Section 12.24.010 of the City Code provides that the owners of the property
being developed are required to dedicate the necessary right-of-way. The
documents granting these easements have been executed by the affected owners
and submitted to the Engineering Department. They have been found to be
satisfactory and are now ready for Council acceptance.
