(4/5ths Vote: Yes No X ) By previous action, Counci`T has revised Condition #17 for the Charter Point Subdivision to require that the developer construct Telegraph Canyon Road as a four-lane divided highway adjacent to their subdivision boundaries. Because of traffic safety concerns, the possibility of a joint project between the City and EastLake for the ultimate construction of Telegraph Canyon Road and a proposed project by the Navy to construct Telegraph Canyon Road, staff does not recommend that Charter Point go ahead with the construction of Telegraph Canyon Road at this time. RECOMMENDATION: That Council approve the resolution approving agreement for construction of Telegraph Canyon Road. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Resolution 12144 revised Condition #17 to allow the entire Charter Point Subdivision to be occupied without the construction of Telegraph Canyon Road ity since the City was working on a revised design for its construct Eion. Csty staff has had meetings with representatives from the Navy, United and EastLake expressing a desire to build a minimum four-lane divided highway (graded for an ultimate s ea a e fafacility) from EastLake westerly to existing four-lane divided highway Developers of Charter Point Subdivision (Pacific Scene and Great American Financial dba Treetops Unlimited) have requested that the City accept a cash payment and release the current 1 i construction bid contract Bond and the Certificate of Deposit. Staff has reviewed a valid submitted to Treetop Unlimited for Telegraph Canyon Road and have determined that the prices involved are reasonable and that the City would be prudent to accept their offer. The agreement provides that Treetops Unlimited will give the City cash in the amount of $828,997 to cover: a) undergrounding of utilities, b) construction of four-lane divided highway with landscaped the necessary median.
