REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) 5 The City Council has previously approved in the 1984-85 and 1985-86 budgets funds for the construction of various street improvements using the 1911 Block Act process. Construction of these improvements have been combined into one project, and the design is now completed. The estimated construction cost for the various improvements is $103,000.00. To reduce the fiscal impact on the City, it is proposed that upon the completion of the work and confirmation of the assessment that bonds be sold. Proceeds from the bonds will reimburse the City for any cash advancements made to cover the property owner' s share of the cost of the improvements. Costs will be assessed on the basis of City Council Policy 505-01 . These budgeted funds could then be used for other proceedings throughout the City. RECOMMENDATION: That the City Council approve the above Resolutions, which will formally initiate the proceedings, approve the proposed boundaries and authorize the Superintendent of Streets to give the formal and legally required notice to the property owners to construct the improvements. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: In the process of forming the 1911 Block Act Phase XVII, the initiation of the proceedings is generally accomplished through the following: 1 . Presentation of map generally showing the boundaries and areas proposed to be assessed. 2. Formal direction and ordering of the property owners to construct the fronting improvements. Under the statute the property owner has sixty (60) days during which he can complete the construction of the street improvements. If, upon the expiration of that 60 day period the property Page 2, Item 20 Meeting Date 8/5/86 owner does not complete the work, the City then acquires the jurisdiction and authority to proceed to order the improvements. The law also requires that during the 60-day period a public hearing shall be held to hear protests. Through the adoption of these Resolutions the City will be setting the required public hearing for September 16, 1986. FISCAL IMPACT: The City funds, as previously budgeted, will be required to be made available for purposes of making payment to the contractor. However, the City will be reimbursed upon the completion of the construction and sale of bonds.
