Approving amendment to FY 1983-87 MOU concerning wages and other terms and conditions of employment with Local 2180, International A sociation of Firefighters SUBMITTED BY: Deputy City Manager Thomson jf REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) The City and Local 2180 of the International Association of Firefighters (IAFF) are just starting the last year of their four-year (FY 1983-87) MOU. The City's negotiating team and IAFF representatives have formulated an amendment to that MOU, and the amendment has been ratified by the IAFF membership. RECOMMENDATION: That Council adopt the resolution approving the amendment. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The amendment to the current MOU primarily involves three issues: (1 ) the refund of employee deductions made for the City's share of PERS; (2) staffing levels subsequent to the absorption of the Montgomery Fire Protection District; and (3) implementation of the Fair Labor Standards Act. The first of these items, the PERS refund, is the subject of a separate report to the Council . In terms of staffing levels, the amendment states that the City will provide a minimum of: 22 Fire Engineer positions until a new fire station is opened; 21 Fire Captain positions until a new fire station is opened; and 5 Battalion Chief positions until any of the existing Battalion Chiefs leaves the department or is promoted. The approved FY 1986-87 budget includes an adequate number of total positions for these minimums, but one Firefighter position will need to be reclassified to a Fire Engineer position. In terms of FLSA implementation, all overtime will be paid at time and a half. Under FLSA requirements, fire suppression personnel would also be paid time and a half for the last 10 hours of the 192 hours of time normally worked in a 24-day work period. The amendment provides that this premium (the extra half time for the last 10 hours of the 192 hours) would not be paid for any work period in which the employee takes a shift or more of paid time off (vacation, sick leave, etc. ). FISCAL IMPACT: The total estimated FY 1986-87 cost of the items covered in the amendment is $77,870, most of which is required by the Fair Labor Standards Act. The existing four-year MOU also provides that the FY 1986-87 base wages of represented Fire employees will be increased by the same percentage as the FY 1986-87 increase for CVEA.
