ITEM TITLE: Resolution 13174 Approving an increase in Development
Impact Fees established by City Council Resolution No. 12409

The Interim Facilities Financing Agreement dated December 19, 1985, between
the EastLake Development Company and the City required that an interim impact
fee for certain public infrastructure required for the development of EastLake
I be established and agreed to. This was accomplished by Resolution 12409 on
March 18, 1986.
An increase in the Development Impact Fees is now before Council for approval .
RECOMMENDATION: That City Council approve the Resolution.

DISCUSSION:
The Interim Facilities Financing Agreement is a mechanism to insure certain
types of public facilities necessary for the development proposed in the
EastLake I project pursuant to the Public Facilities Financing Plan and the
the Development Agreement.
The Interim Development Impact Fees will insure that adequate funds are
available for the construction of the necessary improvements when the need for
said improvements is created due to development in the vicinity of EastLake.
A draft Development Impact Fee Ordinance to establish permanent fees will be
submitted after review and consultation with the County of San Diego and the
many owners/developers in the City and County which will benefit from the
improvements.
It was established by Resolution 12409 that the Development Impact Fees are
subject to an annual increase based on the Engineering News Record (ENR)
Construction Cost Index, if deemed necessary by the City Council . A 2.9%
increase in construction cost has occurred in the past fiscal year according
to said record and we are recommending an increase in the Development Impact
Fees accordingly.

If approved by the City Council , the Impact Fees shown on Exhibit A, Page 1 of
Attachment A of Resolution 12409 will be as follows:

George Simpson and Willdan and Associates have been retained to update the
Facilities Financing Agreement fee structure in conformance with the new
General Plan work. They will be modifying the fee at a later date.
FISCAL IMPACT: Increasing the fee in line with current construction costs
will help assure that funds to provide needed facilities will be available and
adequate.
