(4/5ths Vote: Yes No X ) Oscar Davila is the new owner of the DEA parcel on the west side of Broadway where the new alignment of Telegraph Canyon Channel crosses. City staff and Mr. Davila and his attorney have been working on an agreement to gain a permanent easement and a temporary easement across his property. A couple of clauses in the agreement are still not finalized and is not ready for Council distribution. Staff will distribute the final agreement by June 25. RECOMMENDATION: That Council approve the resolution approving an easement agreement between Oscar Davila and the City of Chula Vista. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. IISCUSSION: The Assistant City Manager and Director of Public Works have been negotiating with Mr. Davila and his attorney to purchase an easement across the former DEA parcel . There is a lengthy agreement involved which basically provides that the City will purchase the permanent easement for $57,200 and Mr. Davila will in addition grant a temporary easement for construction purposes at no cost to the City. There are also provisions in the agreement that if the City is not out of there by November 1 , liquidated damages would accrue based on the chart in the agreement. This chart is included in the construction contract and, if the contractor is not out of there by a certain date, the contractor is responsible to pay for those liquidated damages. Staff expects to award the construction contract for the box culvert between the 200 feet east of Broadway and the connection at 1-5 at the first meeting in July. It is desired by both Mr. Davila and staff, however, to enter this agreement as soon as possible so that the property can go into escrow and close prior to July 24. FISCAL IMPACT: Not applicable.
