Impson, Teresa Impson and Jo Ann Phillips located at 224 Palm Avenue SUBMITTED BY: Director of Public Works/City Engineer REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) A requirement to install public improvements at 224 Palm Avenue which was imposed as a condition of approval for Tentative Parcel Map No. 86-24 has been deferred by the Director of Public Works/City Engineer. A condition of approval of the deferral states that the owner shall either post a cash bond or enter into an agreement with the City to allow a lien to be placed against the property in an amount equal to 110% of the estimated cost of the deferred improvements. Mr. and Mrs. Impson and Mrs. Jo Ann Phillips have properly executed this agreement which must be approved by the City Council . RECOMMENDATION: That the City Council adopt a resolution approving the subject agreement and authorize the Mayor to sign it on behalf of the City. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: In conjunction with the approval of Tentative Parcel Map No. 86-24 for the subject property, the owners were required to install street improvements as specified in the Conditions of Approval prior to the issuance of a building permit. The owners applied for a deferral of the required construction and it was approved by the City Engineer on November 14, 1986. The deferral was based on the opinion that the improvements would have been premature and would be detrimental since they would probably not conform to existing grades and drainage flows would be hampered. Mr. and Mrs. Impson and Jo Ann Phillips state that posting a cash bond poses an extreme economic hardship and therefore request a lien on the property. As a condition of approval of the deferral , the owner was required to enter into an agreement with the City wherein the owners agree: 1 . That they will cause said improvements to be installed within 30 days of written notice from the City Engineer or within three years, whichever occurs first. 2. To post a cash bond in an amount equal to 110% of the estimated cost of the deferred improvements; or, in case of hardship, to allow the City to place a lien against their property at 224 Palm Avenue in Chula Vista and foreclose said lien as a mortgage in case the owners or their successors in interest fail to install the improvements as prescribed for the property at 224 Palm Avenue. That they will not protest the formation of the 1911 Act or other similar proceeding to install improvements.
