HomeMy WebLinkAboutReso 1955-1764 • to e RESOLUTION NO. 1764 RESOLUTION OF THE CITY COUNCIL OF THE ' CITY OF CHULA VISTA APPROVING A LEASE BETWEEN THE CITY OF CHULA VISTA AND BOYS CLUB OF CHULA VISTA THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES HEREBY RESOLVE AS FOLLOWS: That certain lease of real property between the CITY OF CHULA VISTA and BOYSt CLUB 9F CHULA VISTA, a California non- profit Corporation, dated September: 19th, 1955, a copy of which is attached hereto, is hereby apprbved ,and by this reference incorporated herein. DATED: September ,1955. • City Clerk p, /40/(i. � �rc • • • • • • • LEASE OF REAL PROPERTY • • THIS LEASE is made this 19th day of September, 1955, . between the CITY OF CHULA VISTA, a Municipal Corporation, as LESSOR, hereinafter called "City", and BOYS '" CLUB OF CHULA VISTA, a California non-profit Corporation, hereinafter called "Boys ' Club"; WITNESSETH AS FOLLOWS: City hereby leases to Boys ' Club the property hereinafter .x described under the following terms and conditions: (1) Premises. City leases to Boys ' Club a certain parcel of real property situated in the City of Chula Vista, County of San Diego, State of California, and more particularly described as follows: The Southerly 200.00 feet of the Westerly •' 230.00 feet of Lot 9 in Quarter Section • 148 of Rancho de la Nacion, City of Chula Vista, County of San Diego, State of Cali- fornia, according to Map No. 505 filed in the Office of the County Recorder, County of San Dieo, on March 13, 1888. (4+) The purpose of this lease is to provide for the use - • of said premises by Boys ' Club for constructing and operating • thereon a building and other facilities for use as a boys ' Club to promote the physical, mental and moral welfare of boys residing in or near the City of Chula Vista according to the standards of Boys ' Clubs of America and for all reasonable and lawful purpose's incidental thereto, Boys ' Club agrees to use said premises solely for the purpose herein stated. • • (5) Improvements. During the term hereof and at the earliest date practicable and financially feasible, Boys ' Club agrees to construct upon_ the demised premises a building and other facili- ties to be used as a Boys ' Club. (6) Indemnification of City. Boys ' Club agrees to maintain • public liability insurance during the term of this lease covering City as a named insured. The limits of said policy shall be at least $100,000 for each person in each accident with a total coverage of $200,000 for each accident and with property damage • liability in the amount of at least $5,000 for any one accident. • City shall be furnished with a copy of said policy. • (7) Assignment and Subletting. Boys ' Club shall not assign- this lease or any part thereof nor sublet said premises or any • part thereof :without the written consent of City first had and • • obtained.. • • . (8) Compliance with L8 s and Regulations. Boys ' Club agrees to maintain and operate said premises in compliance with all laws, rules and regulations applicable thereto. (9) Termination by City. In the event that Boys ' Club•• fails to maintain and operate said premises for the principal • purpose for which the same are hereby demised or fails to maintain reasonable and adequate supervision and maintenance of said • premises and further fails to remedy any such faults or defects • • -L- within 30 days after written notice so to do from City, then City may elect to terminate and cancel this lease. (19) This `_ease shall be binding upon and inure to the benefit of the successors and asst;ns of the parties hereto, • the same as though they were parties to this lease. IN WITNESS WHEREOF said City of Chula Vista has by duly • adopted resolution of its City Council caused this instrument to be executed by its Mayor and attested to by its City Clerk and its corporate seal to be affixed thereto, and said lessee • has by duly adopted resolution of its membership caused this • • instrument to be executed by its President and Secretary and its corporate seal to be affixed hereto.
