HomeMy WebLinkAboutAgenda Statement 1987/06/02 Item 4 COUNCIL AGENDA STATEMENT Item 4 Meeting Date 6/2/87 ITEM TITLE: Resolution rnar Granting Waiver of Additional Residential Construction Tax to Bonita Long Canyon Partnership for park improvements SUBMITTED BY: Director of r and Recreation REVIEWED BY: City Managers' ' (4/5ths Vote: Yes No X ) As a condition of approval of the tentative subdivision maps for Bonita Long Canyon, the developer, Bonita Long Canyon Partnership, was required to construct a turnkey park totaling 6.5 acres in size that would be completed with Phase III Subdivision Map Development. The Planning Commission and the City Council previously approved a waiver of Park Acquisition and Development (PAD) fees in the amount of $258,600 and Residential Construction Tax (RCT) in the amount of $57,500. McMillin Development is seeking additional RCT Credit for improvements included in the design of the park that were required by the City. RECOMMENDATION: That the City Council adopt the resolution granting the waiver of $226,153 in RCT funds for Bonita Long Canyon. BOARDS/COMMISSIONS RECOMMENDATION: The Parks and Recreation Commission approved the park plan at its May 22, 1986 meeting and is in favor of granting the $226,153 waiver of additional RCT funds. DISCUSSION: Several meetings were held between the developer and Parks and Recreation Department staff to design a park that would meet the needs of the community. The improvements approved by the department and the Parks and Recreation Commission include a par course, two balifields with backstops, restroom, tot lot, walkways, noise wall , storm drain, parking lot, security lighting, and fencing. These improvements exceed the basic items required in a park according to Section 17.10.070 of the City's ordinance regarding subdivider Park Development and Responsibility. The ordinance states that the park must be graded, street improvements installed, utilities extended to the property line, an automatic irrigation system and turf be installed, and that one tree per thousand square feet of land be planted. The cost of these basic improvements is approximately $300,000 for this park and is partially offset by the previous waiver of all Park Acquisition and Development (PAD) fees. The total cost for development of the park is approximately $710,000, not including value of the park land. Page 2, Item 4 Meeting Date 6/2/87 Attached (Attachment A) is a listing of the park improvements, for which credit should be given, and their associated costs. As listed, this cost is $226,153. The Engineering Department has checked the accuracy of these figures. Construction of the park will be monitored by the City , as the various construction permits are pulled by the developer. The developer will send copies of the successful bids for the construction to the Parks and Recreation Department so that the bid costs of the improvements will be known and an accurate waiving of RCT fees can be accomplished. In exchange for the waiver of $258,600 in PAD and $283,653 in RCT fees, for a total of $542,253, the City is receiving a quality park. FISCAL IMPACT: Had the City accepted PAD and RCT fees in lieu of the development of the park, the City would have received $732,700, which would not have covered purchase and development of the park land. As recommended by staff, the developer will receive a $283,653 waiver ($226,153 in current RCT waiver plus $57,500 in previous RCT waiver), with the City still receiving approximately $190,447 in RCT funds.
