In accordance with Section 15.04.285 of the City Code, the applicant must enter into an agreement with the City. The agreement has been executed and is ready for Council approval . RECOMMENDATION: That Council adopt the subject resolution and authorize the Mayor to sign the subject agreement on behalf of the City. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: A plan for the uncontrolled embankment was submitted to this department and a check of these plans show they substantially conform to normal engineering practice. The proposed embankment is filling an existing depression within the rear yards of three different properties, 1001 Guatay, 1005 Guatay Avenue and 148 Inkopah. The finished grades will conform to surrounding improvements and original ground, and will not be aesthetically unpleasant. A letter of permission to grade has been signed by each of the owners and submitted to the Engineering Department. The fill is proposed to originate at various Sweetwater Authority projects and will be delivered to the subject sites. Based on the findings herein, it is recommended the agreement for the uncontrolled embankment be approved with the following conditions in accordance with Section 15.04.285 of the City Code: 1 . The applicants' must enter into an agreement for the uncontrolled embankment with the City of Chula Vista, which must be approved by City Council . 2. The site shall not be eligible for a building permit unless special soils analysis and foundation designs are submitted and approved prior to obtaining a building permit. Page 2, Item 4 Meeting Date 5/19/87 The owners shall , while the agreement is in effect, maintain the site in a safe and sanitary manner at the sole cost, risk and responsibility of the owners and their successors in interest, who shall hold the City harmless with respect thereto.
