HomeMy WebLinkAboutAgenda Statement 1987/05/12 Item 17 COUNCIL AGENDA STATEMENT Item 17 Meeting Date 5/12/87 ITEM TITLE: PUBLIC HEARING: South Levee Road repair and maintenance Coastal Development Permit RESOLUTION/,,Mg 9 Authorizing the issuance of a Coastal Development Permit to the City of Chula Vista Redevelopment Agency for the repair and maintenance of the south levee road SUBMITTED BY: Community Development Directors REVIEWED BY: City Manager ( (4/5ths Vote: Yes No X ) The Redevelopment Agency of the City of Chula Vista would like to undertake repair and maintenance of the south levee road that connects the Midbayfront to Gunpowder Point. The proposed repair and maintenance of the south levee road was designed to provide all -weather access to the Nature Interpretive Center for emergency vehicles and shuttle buses. The goal of the project is to repair the road prior to the public opening of the Nature Interpretive Center on July 4, 1987, while minimizing the potential environmental impacts. This project is exempt from review under CEQA pursuant to Section 15301 Class 1 (c). The plans for repair and maintenance are attached for City Council review as Exhibit A. RECOMMENDATION: That the City Council conduct a public hearing and consider the attached resolution, and findings therein, which finds that the proposed south levee road repair and maintenance is consistent with and adequate to carry out the policies of the certified Chula Vista Bayfront Local Coastal Program (LCP) and issue a Coastal Development Permit for said repair and maintenance. BOARDS/COMMISSIONS RECOMMENDATION: Not Applicable DISCUSSION: The proposed repair and maintenance consists of placing 0-6 inches of aggregate base on top of engineering fabric; installing a 6-inch by 8-inch piece of lumber, held in place by reinforced metal bar along the south side of the road to retain the aggregate; and attaching "L" shaped metal plates to the lumber in the area directly above the culvert to provide stability. A piece of lumber is also proposed for installation along the northern side of the road in the area above the culvert. The engineering fabric and the lumber are designed to retain the aggregate to prevent it from entering the wetlands. Page 2, Item 17 Meeting Date 5/12/87 Because of past experiences with construction on and adjacent to the south levee road, the City should plan to have a biologist or other knowledgeable, responsible party on-site to supervise construction of the proposed repair and maintenance. This supervision will ensure that the contractor limits all repair and maintenance activities and placement of aggregate to the surface of the existing south levee road and that no aggregate is placed on the sides of the existing levee. Staff will either come back to the Agency with a proposal to hire a biologist or use existing staff members to provide the required supervision. To limit the potential environmental impacts of the project, the contractor will be allowed only 10 working days on the site to complete the repair and maintenance. The Engineering Department estimates that the work will actually take less than 5 working days, but placing more of a strict limitation on the contractor would increase the cost of the project. The repair and maintenance activities will be staged from the Midbayfront, and all construction equipment will be stored in the Midbayfront at least 300 feet back from the wetland area to minimize any disturbance. Based on the following findings, the proposed south levee road repair and maintenance project has been found to be consistent with the policies of the certified Chula Vista Bayfront LCP. 1 . The repair and maintenance of the south levee road is not considered new development pursuant to Section 30212(b) (5) of the Public Resources Code. As a result, the repair and maintenance work is not subject to the public access requirements for new development. The repair and maintenance of the south levee road will not, however, have adverse impacts on lateral public access to the coastline as it will allow access to the Nature Interpretive Center by shuttle bus. 2. Consistent with Section 30240(b) of the Public Resources Code, the repair and maintenance of the south levee road was sited and designed to prevent impacts which could significantly degrade the adjacent areas. The repair and maintenance of the road for use by shuttle buses is compatible with the continued use of the adjacent wildlife habitat areas. The following measures were included in the project design to minimize potential environmental impacts: a. Engineering fabric and lumber were included in the project design to retain the aggregate to prevent it from entering the wetlands. b. A biologist or other knowledgeable, responsible party will be on-site to supervise the repair and maintenance work. The supervision will ensure that the contractor limits all construction activities and placement of aggregate to the surface of the existing south levee road and that no aggregate is placed on the sides of the existing levee. � T Page 3, Item 17 Meeting Date 5/12/87 c. The contractor will be allowed only 10 working days on the site to complete the repair and maintenance. d. Repair and maintenance activities will be staged from the Midbayfront, and all construction equipment will be stored in the Midbayfront at least 300 feet back from the wetland areas. 3. The Statewide and Regional Interpretive Guidelines have been reviewed and the proposed repair and maintenance of the south levee road will maintain the functional capacity of the adjacent environmentally sensitive habitat areas because it will not significantly degrade an environmentally sensitive habitat area. In addition, consistent with the Statewide Interpretive Guidelines, the City Council has set limits and conditions on the development. 4. The repair and maintenance of the existing south levee road will not preclude the improvements to that roadway specified in the Bayfront Specific Plan. 5. Grading for the south levee road repair and maintenance project is not permitted between November 1 to April 1 to adhere to the LCP grading requirement which is intended to minimize the potential for siltation in wetlands. FISCAL IMPACT: The cost to the Redevelopment Agency to implement the south levee road repair and maintenance work is estimated at $24,960.
