REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) As previous actions on the same agenda, the City Council has been asked to approve formation of an assessment district for the construction of street improvements for Las Flores Drive, north of "D" Street and to approve three Final subdivision Maps abutting on the proposed Las Flores Drive. The items listed above all relate to those actions. RECOMMENDATION: That Council adopt the resolutions listed in the title above. ALTERNATIVE RECOMMENDATION: That Council adopt a resolution not accepting the above offered easements, in the event that the assessment district is not formed. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: The above listed easements generally fall into four categories: 1 . Easements and/or street dedications necessary to comply with conditions of approval of Tentative Parcel Maps. Tentative Parcel Maps 84-25 (Livesay) Page 2, Item 15 Meeting Date 4/14/87 and 85-11 (Ohlau/Perrott) were conditionally approved by the Director of Planning and the Director of Public Works on May 31 , 1984, and July 5, 1985, respectively. Among the conditions of approval for both maps were the requirements to dedicate additional right-of-way for Second Avenue, to dedicate the required right-of-way for Las Flores Drive and to grant tree planting and maintenance easements along both streets. The right-of-way requirement for Second Avenue arises from a situation unique to the east side of that block of Second Avenue. The property line is located 24 feet from the centerline of the street, but the back of the sidewalk is 25. 5 feet from the centerline. After dedication, the property line will be located 28 feet from the centerline, thus conforming with City standards. Grants of easements executed by the Livesays, Mr. Ohlau and Ms. Perrott (now Mrs. Harmon) fall into this category. 2. Street dedications acquired from property owners through negotiations with City staff. City staff has been negotiating with property owners to purchase right-of-way necessary for construction of a fully improved street to provide access to all property owners. The easements for street purposes from Mr. Ham ("D" Street), Ms. Simpson, Mr. and Mrs. Shepard, and Mascot Realty (Las Flores Drive) all are in this category. The property owners are to be compensated for the easements as a part of the right-of-way acquisition costs portion of the Improvement District financing or will receive a credit against their respective assessments. 3. A drainage easement necessary for relocation of a storm drain pipe in conjunction with one of the subdivisions. The existing storm drain running from a curb inlet on Second Avenue toward Las Flores Drive is located in the middle of several proposed lots in Chula Vista Tract 77-10 (Hudson Valley Unit 1 ). The developer proposes to relocate the storm drain to the side of the proposed lots. The easement presented here is for that portion of the pipe relocation that occurs outside the subdivision boundary. The easement within the subdivision boundary has been presented for acceptance in conjunction with approval of the Final Subdivision Map. 4. A grant of easement for street purposes, executed by Mascot Realty, located on the northerly extension of Las Flores Drive. Said easement is presented to the City Council for acceptance only. The purpose of this easement is to allow for possible extension of the street in the future, while denying access to rights to control future development. At the meeting on April 7, 1987, City Council set May 5, 1987, as the date for a public hearing for condemnation of certain properties required for street right-of-way for the assessment district. Easements for said street rights-of-way have now been executed by Mascot Realty and are presented here in items 2 and 4. The public hearing, therefore, will not be necessary. Exhibits are available for Council viewing. FISCAL IMPACT: None. Property owners will be compensated as described in category 2 above.
