On April 7, 1981 , by Resolution 10424, the City Council approved the Tentative
Map for Chula Vista Tract 77-10, Hudson Valley Estates Unit No. 1 . The Final
Map for said subdivision located in the Las Flores Drive Assessment District
is now before the City Council for approval .
RECOMMENDATION: That Council adopt the resolutions as listed in the title
hereto if Council approves formation of the Assessment District 85-1 (Las
Flores Drive).
ALTERNATE RECOMMENDATION: That Council deny approval of the final map if
Council does not approve formation of the Assessment District.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The final map for Chula Vista Tract 77-10 has been checked and found to be in
conformance with the tentative map. The owners have paid all fees and
submitted all required documents and bonds. All conditions of approval have
been met with the exception of Condition 2c. which requires construction of
street improvements in Las Flores Drive. Assessment District 85-1 is proposed
as the method of guaranteeing and constructing said improvements. If Council ,
by previous action, has approved formation of Assessment District 85-1 (Las
Flores Drive) , staff considers this to be adequate guarantee of construction
of said street improvements as required by the State Subdivision Map Act and
the Municipal Code and it would be appropriate to approve the subject final
map. If Council has chosen to not approve formation of the district, then it
would be inappropriate to approve the subject final map until such time as the
developer provides adequate surety bonds and enters into a subdivision
improvement agreement to guarantee the required improvements as required by
the Map Act.

Additionally, if said district is not formed, sufficient right-of-way to
construct said improvements must be acquired by the developer. Said
right-of-way has been presented for acceptance in a previous action tonight in
conjunction with approval of Chula Vista Tract 82-7 (Las Flores Subdivision)
which is also conditioned upon formation of the Assessment District.
The sewer easements proposed to be vacated are an easement from Second Avenue
to Las Flores Drive for a sewer main and an easement adjacent to Las Flores
Drive for a sewer pump station. The main and the pump station were abandoned
in 1980 when a gravity sewer main was extended to the Spring Valley Sanitation
District trunk sewer. Said easements were accepted by Resolutions 953, 1017,
1019, and 1020.
The drainage easement proposed to be vacated is for an existing 18-inch storm
drain from an inlet in Second Avenue running down the hill to Las Flores
Drive. Said easement was accepted by Resolution 9179 on July 11 , 1978. The
developer will be relocating the storm drain to place it adjacent to the lot
lines of the proposed subdivision. Suitable replacement easements are
provided. The portion of the proposed replacement easement within the
subdivision is granted to the City in the Final Map. The remainder has been
presented for acceptance as a separate action.
Approval of the final map includes acceptance of the drainage and access
easements to maintain drainage facilities. The right-of-way for Las Flores
Drive adjacent to this subdivision and tree planting and maintenance easements
adjacent to dedicated streets were granted to the City in 1978 as conditions
of approval for a parcel map recorded for the subject property.
A plat is available for Council viewing.
