This resolution is in response to the Police Department' s request for
additional parking spaces. Because of the increased size of our Police force
and the increase in the number of vehicles currently in use, it has become
necessary to gain additional parking for Police Department vehicles. this
parking would be gained on that portion of street adjacent to the Police
Station on both Davidson Street and Fourth Avenue.
RECOMMENDATION: That City Council adopt this resolution to make
preferential parking for Police vehicles on City streets legal and defined,
and to make violations of this parking restriction readily enforceable.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Because of recent increases, the Police Department has outgrown its current
parking lot capacity. Since the area surrounding the Police Department has no
space available for additional official vehicle parking, it has become
necessary to place Police vehicles on the street. This resolution when
adopted by City Council will provide parking for an additional 16 "official
cars."
The resolution will restrict parking on the south side of Davidson Street from
Guava Avenue east to Fourth Avenue.
Further, this resolution will restrict parking on the west side of Fourth
Avenue from south of Davidson Street to Memorial Way.
This resolution is established in conjunction with enabling Section 22507 of
the California Vehicle Code amended in 1985 to allow local authorities to
establish preferential parking on public streets which are deemed reasonable
and necessary.

This resolution is established pursuant to Section 10.52.070, "No Parking
Areas-Designated," and Section 10. 52.280, SCHEDULE III. "Parking-Prohibited
at all times on certain streets" which states, "pursuant to resolution or
ordinance of the city council , and when appropriate signs have been erected
giving notice thereof, no person shall park a vehicle at any time upon any of
the streets or portions of streets as follows:

within 100 feet of any intersection,on certain streets or highways,or portions
thereof,during all or certain hours of the day.The ordinance or resolution
may include a designation of certain streets upon which preferential parking _---
privileges are given to residents and merchants adjacent to the streets for
their use and the use of their guests, under which the residents and
merchants may be issued a permit or permits which exempt them from the •

22507.2. Notwithstanding subdivision (e) of Section 22500, a local
authority may, by ordinance,authorize the owner or lessee of property to
park a vehicle in front of the owner's or lessee's private driveway when the
vehicle displays a permit issued pursuant to the ordinance authorizing such

The local authority may charge a nonrefundable fee to defray the costs of
issuing and administering the permits.
A local ordinance adopted pursuant to this section may not authorize
parking on a sidewalk in violation of subdivision (f) of Section 22500,

10.52.050 No stopping zones and no parking areas-Authorized.
The city engineer is hereby authorized to maintain, by appropriate signs
or by paint upon the curb surface, all no stopping zones, no parking areas,
and restricted parking areas, as defined and described in this chapter.

10.52.060 No stopping zones and no parking areas-Driver obedience required.
When said curb markings or signs are in place, no operator of any vehicle
shall stop, stand or park such vehicle adjacent to any such legible curb
marking or sign in violation of any of the provisions of this chapter.

* 10.52.070 No parking areas-Designated.
A. No operator of any vehicle shall stop, stand, park or leave standing such
vehicle in any of the following places, except when necessary to avoid
conflict with other traffic or in compliance with the directions of a
poltce officer or other authorized officer, traffic sign or signal :
1 . In any area established by the city council as a no parking area where
such area is indicated by official signs or red paint on the curb;
2. On a sidewalk;
3. Within an intersection;
4. Within a crosswalk;
5. Alongside or opposite any street excavation or obstruction when such
standing, stopping or parking would obstruct traffic;
6. On the roadway side of any vehicle stopped or parked at the edge or
curb of the street;
7. Upon any bridge or other elevated structure upon a highway or within a
highway tunnel ;
8. Upon, along or across any railroad track in such manner as to hinder,
delay or obstruct the movement of any car traveling upon such track;
9. Within any divisional island unless authorized and clearly indicated
with appropriate signs and markings;
10. In front of a public or private driveway or within eight feet of the
end of the curb radius leading thereto;
11 . Within twenty feet of a crosswalk at an intersection;
12. Within twenty feet of the end of the curb radii at intersection;
13. Within thirty feet of the approach to any flashing signal , stop sign
or traffic control signal located at the side of the roadway;
14. Within any of those places delineated by Section 22500 of the Vehicle
Code.
B. No person shall move a vehicle not lawfully under his control into any
such prohibited area or away from a curb such a distance as is unlawful .
C. For the purpose of minimizing traffic hazards and traffic congestion, the
city engineer is authorized to establish no parking' or stopping zones.
The length of these zones is not to exceed two hundred feet.

disabled vehicle by the driver thereof. The continuous flashing of at
least four approved Class A-type 1 turn signals, at least two toward the
front and at least two toward the rear of the vehicle, shall be considered
to meet the requirements of this section until the devices mentioned above
can be placed in the required locations. The warning signals herein.

vehicle remains disabled upon such street or highway.

10.52.250 Standing or parking-Applicability of provisions.
The provisions of this chapter, prohibiting the standing or parking of a
vehicle shall apply at all times or at those times herein specified or as
indicated on official signs except when it is necessary to stop a vehicle to
avoid conflict with other traffic or in compliance with the directions of a
police officer or official traffic-control device. (Ord. 973 S. 1 (part) ,

10.52.260 Parking-Scope of provisions.
The provisions of this chapter imposing a time limit on parking shall not
relieve any person from the duty to observe other and more restrictive
provisions prohibiting or limiting the stopping, standing or parking of
vehicles in specified places or at specified times. (Ord. 973 § 1 (part) ,

vehicle at any time upon any of the streets described in Section 10.52.280 and

In accordance with Section 10.52.270, pursuant to resolution or ordinance

holding zones, the City Manager is hereby authorized to determine the location of Loading

SEC.86.07 TEMPORARY NO PARKING
The Chief of Police is authorized to erect or place temporary"No Parking"signs on streets
or portions thereof: .
(a)Where such street is undergoing repairs,construction or the installation of underground
• utilities;or,'"
(b)Where the use of such street is authorized for purposes other than the normal flow of
. traffic;or,
(c)Where such street is being used for the movement of equipment,articles or structures
of unusual size. Such temporary "No Parking" signs shall be erected or placed at least 24
hours prior to the removal of any vehicles under or pursuant to Section 81.09.

rub in the Central Traffic'District between the Hours of 10:00 a.m.and 6:00 pm • •
(b)No person shall'park°or stand any vehicle backed into the curb or headed into the -
cub on any highway designated as a through highway between the hours of 4:00 p.m.and
6:00 p.m.
(c)The City Manager may prohibit the parking or standing of'iny=vehicie backed into

DISCUSSION:
As a result of City growth, the Police Department has outgrown its current
parking lot capacity. Since the area surrounding the Police Department has no
space available for additional official vehicle parking, It has become
necessary to place Police vehicles on the street. This resolution when
adopted by City Council will provide parking for an additional 16 "official
cars." The resolution will restrict the portion of Davidson Street east of
the driveway to the Police Department compound (Guava Avenue) a distance of
194 feet (9 marked stalls) east to the driveway exiting the Police
Department' s east parking lot (Fourth Avenue) , on the south side of Davidson
Street. This area covers the south side of Davidson Street from Guava Avenue
to Fourth Avenue.
Further, this resolution will restrict the portion of Fourth Avenue south of
Davidson Street a distance of 152 feet (7 marked stalls) south of the driveway
entering the Police Department' s east parking lot, on the west side of Fourth
Avenue. This area covers the west side of Fourth Avenue from Davidson Street
to Memorial Way.

curb of the street;
7. Upon any bridge or other elevated structure upon a highway or within a
highway tunnel ;
8. Upon, along or across any railroad track in such manner as to hinder,
delay or obstruct the movement of any car traveling upon such track;
9. Within any divisional island unless authorized and clearly indicated
with appropriate signs and markings;
10. In front of a public or private driveway or within eight feet of the
end of the curb radius leading thereto;
11 . Within twenty feet of a crosswalk at an intersection;
12. Within twenty feet of the end of the curb radii at intersection;
13. Within thirty feet of the approach to any flashing signal , stop sign
or traffic control signal located at the side of the roadway;
14. Within any of those places delineated by Section 22500 of the Vehicle
Code.
B. No person shall move a vehicle not lawfully under his control into any
such prohibited area or away from a curb such a distance as is unlawful .
C. For the purpose of minimizing traffic hazards and traffic congestion, the
city engineer is authorized to establish no parking or stopping zones.
The length of these zones is not to exceed two hundred feet.

hundred feet to advance of, and one hundred feet to the rear of such
disabled vehicle by the driver thereof. The continuous flashing of at
least four approved Class A-type 1 turn signals, at least two toward the
front and at least two toward the rear of the vehicle, shall be considered
to meet the requirements of this section until the devices mentioned above
can be placed in the required locations. The warning signals herein
mentioned shall be displayed continuously during darkness while such
vehicle remains disabled upon such street or highway.

10.52.250 Standing or parking-Applicability of provisions.
The provisions of this chapter, prohibiting the standing or parking of a
vehicle shall apply at all times or at those times herein specified or as
indicated on official signs except when it is necessary to stop a vehicle to
avoid conflict with other traffic or in compliance with the directions of a
police officer or official traffic-control device. (Ord. 973 § 1 (part) ,

10.52.260 Parking-Scope of provisions.
The provisions of this chapter imposing a time limit on parking shall not
relieve any person from the duty to observe other and more restrictive
provisions prohibiting or limiting the stopping, standing or parking of

required.
When signs are erected giving notice thereof, no person shall park a
vehicle at any time upon any of the streets described in Section 10.52.280 and

The Chief of Police is authorized to erect or place temporary"No Parking"signs on streets
or portions thereof:
(a)Where such street is undergoing repairs,construction or the installation of underground

(b)Where the use of such street is authorized for purposes other than the normal flow'of

SUBJECT: Recent Parking Changes at the Civic Center
In and Around the Police Department
1. Signing and marking nine (9) stalls on the south side of Davidson Street
between Guava Avenue and Fourth Avenue, for "official cars only".
2. Signing and marking seven (7) stalls on the west side of Fourth Avenue
between Davidson Street and Memorial Way, for "official cars only".
3. Removal of red-curb on the east side of Fourth Avenue south of Davidson
Street to allow for the parking of four (4) additional vehicles, either
public or employee. These parking stalls are to replace the four stalls
lost on the west side to official vehicles.
4. Changing the designation of four (4) stalls in the lot east of the Police
Department building from public to "official vehicles only".
5. Restriping the lot west of the Police Department building to gain an
additional eight (8) parking stalls.
6. The net results of the above changes are:
a. Twenty-eight spaces gained for police/official vehicles.
b. Loss of four off-street visitor parking stalls.
c. Loss of seven on-street public/employee parking spaces.
Employee Parking
Restripe areas of the employee parking lot west of the Fire Department to
"compact car only" - 12 spaces gained.
City Vehicles
Restripe the lot east of the Public Services building to gain three (3)
additional parking spaces.

1. Proposal to reconstruct the area north of the Fire Station would gain
eight (8) spaces.
2. Proposal. to gain six (6) more spaces in the area east of the Public
