ITEM TITLE: a) Resolution ' � Approving the Initial Study and Negative
Declaration (IS-83-22) for the Las Flores Drive Assessment
District
b) Resolution Declaring intention to order the
construction of certain improvements in a proposed assessment
district; declaring the work to be of more than local or
ordinary benefit; describing the district to be assessed to
pay the cost and expenses thereof; and providing for the
issuance of bonds

At the meeting of July 8, 1986, Council approved a map showing the proposed
boundaries of Special Assessment District designated as Assessment District
No. 85-1 (Las Flores Drive) and directed staff to call for bids for said
assessment district. Staff received bids for this project on September 17,
1986, and prior to award of the contract it will be necessary to hold the
public hearing on the assessment district.
RECOMMENDATION: That Council accept the resolutions.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Staff over the last several years has been working with the various property
owners to form an assessment district north of "D" Street between Second
Avenue and Minot Avenue. The Council ' s action tonight generally is to receive
and approve the preliminary Engineer' s Report and authorize the sale of
bonds. The public hearing is set for April 14, 1987, at 7:00 p.m. At the
public hearing, City Council will consider confirmation of the assessments for
the improvements, accept proposals for sale of bonds, award the construction
contract and approve several subdivision maps adjoining the improvements at
that meeting.

Attached to this agenda statement is a copy of the Engineer' s Report and
associated assessment diagram. Also attached is a map showing the status of
the existing right-of-way needs regarding construction of this project. It is
anticipated that one parcel of property may have to be acquired through
eminent domain proceedings for construction of the project. Staff will be
working with the property owner and the City Attorney' s office to resolve this
matter prior to the public hearing on April 14th.
The work involved in this assessment district will include clearing of the
site, grading, curbs, sidewalk, driveway approaches, water and fire protection
facility, drainage facilities, underground electrical , telephone, cable
television facilities, and street lighting together with appurtenances and
appurtenant work to serve the benefitted properties.
Mr. Diven with Brown and Diven Law Offices will be present at tonight' s
meeting to answer any questions concerning these proceedings.
FISCAL IMPACT: City Council at its meeting of November 18, 1986, approved
the concept of funding the reserve fund in conjunction with this assessment
district. At the meeting of April 14, 1987, staff will have an appropriate
resolution appropriating the funds in the amount of about $150,000 to cover
this cost. It is anticipated that the City will receive repayment of the
reserve fund plus interest earnings over the 15-year term of the bonds.
