hearing on March 17, 1987 to consider the vacation of Fifth
Avenue between "H" and "I" Stree

The Homart Development Company is requesting that the City consider closure of
Fifth Avenue between "H" and "I" Street as part of their proposal to redevelop
the Chula Vista Shopping Center. The closure will allow integration of the
Sears and Broadway centers currently separated by Fifth Avenue.
Homart is currently in escrow to purchase portions of the center owned by the
Louis Nohl Trust and Carter Hawley Hale which will expire on April 30, 1987.
Close of the escrows are pursuant to a decision on closure of Fifth Avenue.
Homart is requesting a decision by mid-March so that, in the event the project
proceeds, there will be adequate time to develop necessary financing documents
and a DDA with the Redevelopment Agency.
RECOMMENDATION: That the City Council adopt the resolution stating intention
to conduct a public hearing on March 17, 1987 to consider the vacation of
Fifth Avenue between "H" Street and "I" Street, and authorize appropriate
advertisements for said hearing.
BOARDS/COMMISSIONS RECOMMENDATION: The Planning Commission held the requisite
public hearing on the EIR for the renovation of the Chula Vista Shopping Center
including the closure of Fifth Avenue on Wednesday, January 28, 1987. Revisions
to the EIR, pursuant to comments received in writing and at the public hearing,
have been incorporated. The EIR has been resubmitted to the Planning Commission
for consideration and certification at their meeting of February 25, 1987.
DISCUSSION:
In order to consider the vacation of a street, state law requires that a public
hearing be held and that the hearing be advertised a minimum of two weeks in
advance of the hearing date. In order to comply with the development schedule
for the proposed project and the preparation of requisite documents including
the DDA before the close of escrow on April 30, it is necessary to hold the
hearing and consider the vacation of Fifth Avenue early in March. The earliest
date that the hearing can be held in compliance with advance advertising require-
ments is at the regular City Council meeting of March 17, 1987. The Engineering
Department has received the necessary applications and supporting documentation
from the applicant and is currently reviewing the closure request. A staff
report and recommendation will be prepared for the March 17 meeting.
