the EastLake Assessment District N . 85-2 projects

EastLake Assessment District No. 85-2 consists of four contract projects. The
projects are:
1 . Phase 1 , 5 M.G. Steel Reservoir, Trusco Tank Co. , Contractor
2. Phase 2, 980 Zone Pump Station, Olson Construction Co. , Contractor
3. Phase 3-A, Construction of Otay Lakes Road, sewer, and water lines and all
appurtenances, Olson Construction Co. , Contractor
4. Phase 3-B, 20" off-site water pipeline, Thibodo Construction Co. ,
Contractor
On November 4, 1986, Council , by Resolution No. 12804, approved an extension
of contract time (to February 28, 1987) for projects 1 , 2 and 4 above.
Contract No. 3 was also extended to February 28 at a later time by the City
Council (Resolution No. 12849, adopted on December 16, 1986). The extension
of the contract time for each project was due to a delay in the delivery of
the telemetry cable which must interface in size, color coding and number and
is to be installed by each contractor.
Olson Construction Co. , the contractor for the 980 Zone pump station project,
has requested another extension of time for this project. Their request is
again due to equipment delivery delays. This time, they have encountered
difficulty in obtaining delivery of electrical switch gear for the pump (see
attached letter) . Their request is to extend the contract to April 15, 1987.
This request is considered appropriate and is recommended by the Otay Water
District. The pump station completion date affects the completion of work
under the other three contracts. The Otay Water District also recommends that
the other three contracts be extended as well (see attached letter).
RECOMMENDATION: That Council adopt a resolution approving extension of
contract time to April 15, 1987, for the EastLake Assessment District 85-2
contracts.

DISCUSSION:
EastLake Assessment District 85-2 involves construction of major
infrastructure facilities needed to serve the EastLake Planned Development.
The work now under construction was awarded by the City in four separate, but
closely interrelated contracts amounting to about $7.8 million. The contracts
are at various stages of construction and are proceeding in a timely manner,
considering the fact that several contractors, agencies and developers are
involved. Conflicts have been reduced to a minimum through the cooperation
that exists amongst all parties concerned.
The EastLake Assessment District 85-2 projects were approved by both the City
and Otay Water District on a "fast track" basis. One of the difficulties
generally encountered when projects are processed in a "fast track" basis is
that contractors encounter problems obtaining equipment on time to meet their
contractual obligations. This has occurred once already with the delivery of
a telemetry cable acceptable to Otay Water District and needed to provide
communications between equipment at the reservoir and the pump station.
Accordingly, Council was requested to approve contract time extensions to
accommodate the cable delivery time delay.
Olson Construction Co. has requested a second extension of time for their 980
zone pump station project. They have submitted information which shows a
diligent effort in obtaining the electrical motor control equipment they are
to install per their contract. We have met with the contractor, Otay Water
District representatives, and EastLake Development Company officials to
discuss the time extension request. We concur with the validity of the
request and recommend that the contract be extended to April 15, 1987, as
requested.
The extension of time for the 980 Zone pump station contract, however, affects
the contractual time obligations of the other three projects. Otay Water
District requires that the reservoir and water main connecting it to the pump
station be bacteria tested and chlorinated at the same time. The reservoir,
however, cannot be filled until the pump station is operational . Thus,
although the reservoir and water line projects are virtually complete, Otay
Water District has requested that the other three contracts be extended to
accommodate the pump station project. Since the Otay Water District will be
the ultimate owner of the water facilities, we concur with their
recommendation. We have contacted the contractors affected by the contract
time extensions and they have no objection to the proposal .
It should be noted, however, that the Otay Water district is responsible for
providing a control panel for the pump station. They are having problems
obtaining the panel and may request a further extension of the pump station
contract. The pump can be operated without this panel and will not affect the
acceptance of the work under the other contracts. We have a question as to
the responsibility for the installation of the panel . The Contractor has
stated that the installation is not part of his contract. Since neither the
plans nor the specifications are clear on this item, we may have to negotiate

a change order with Olson Construction for the installation of the panel . Any
additional costs due to the installation and/or time delays may have to be
paid by either the Otay Water district and/or the EastLake Development
Company, unless it is decided that the Assessment District proceedings are
legally bound to cover this possible extra cost. This is provided to you as
informational material only. We are looking to successfully resolve the
installation of the panel without either a cost increase or time extensions.
FISCAL IMPACT: EastLake Assessment District 85-2 will pay the added cost
for staff time necessary to conduct the required inspection and administration
of the contract work. There will be no direct cost to the City for granting
the extension of contract time to April 15, 1987.

Dear Roberto ,
This letter will summarize actions taken in an effort to
expedite the electrical motor control equipment on the
above referenced project .
On May 8 , 1986 , contractor requested a meeting with all
concerned as Westinghouse was questioning the requirements.
This meeting was held at SDG&E meter shop. Those present
were Paul Saxton and Dan Vannice of SDG&E , Jim Wagenman
of Lowry and Associates, Chuck Dobbins of Blackhawk Ind., ,
Inc. , Larry Doyle and Manual Arroya of Otay Water District ,
Mark Balan of Balan & Associates , Frank Herget of
Westinghouse Corp. , and Will Pflugh , Jay Whalen and Tom
Cooper of Olson Construction Co. All items in question
were discussed and the meeting concluded with what we
thought was a clear understanding of what was required
and acceptable. Electrical submittals were promised and
expected to be in between 8 and 12 weeks.
There were many calls made by contractor to subcontractor
and many from subcontractor to Westinghouse as evidenced
by attached Blackhawk letter dated January 21 , 1987.
Many of which 'i`rxi sure did not get recorded.
Finally, on August 28 , 1986 we received a partial and
more followed until complete MCC equipment submittals were
in, October 18 , 1986.
Each submittal was hand carried to Otay Water District
the day they were received by the contractor.
Otay Water District reviewed the complete package (MCC
equipment submittals) and we received it back November 4 ,
1986 approved with corrections noted (corrections were
very minor) .
Olson ' s letter dated October 23 , 1986 to the City of
Chula Vista alerted of our first notification of an
extended lead time. At that time, we requested the city
or their consultant to assist in expediting delivery of
equipment by talking to Westinghouse because they were
the specifiers.
We have previously contacted Larry Doyle at Otay Water
District and Rod Myers of Eastlake Development both to
assist by calling Westinghouse.
On December 22 , 1986 , we received, through Blackhawk Ind. ,
a letter from Westinghouse dated December 17 , 1986 which
we sent to Otay Water District with a copy to you.
We have always and are still trying to expedite delivery
of this equipment .
Attached, please find a copy of Blackhawk Ind. , Inc . memo
dated January 8 , 1987 pushing the delivery date of the
longest lead item piece of equipment up to February 27 , 1987
in lieu of Westinghouse ' s previously notification of
March 31 , 1987.
With this new delivery date from Westinghouse , if it is
met , our request for extention time would be for contract
completion April 15 , 1987 in lieu of May 15 , 1987 ,
previously requested in ourletter of December 24 , 1986 .
If there is any other information required to extend the
contract time , please do not hesitate to call .

Dear Mr. Saucedo:
This letter is to corroborate our conversation of this date
concerning time extensions for the subject projects. In
reference to Mr. Tom Cooper ' s letter from Olson Construction
Company, dated January 26, 1987 and addressed to you, the
revised schedule for completion of the pump station is April
15, 1987. The extension is due to the late delivery of the
Westinghouse electrical panels.
Additionally, Contract IIIA, Contract IIIB, and the 5 MG
Reservoir projects are dependent upon water being available
from the pump station to maintain a minimum bacteriological
requirement of the water within the water mains and the
reservoir. Following availability of water to the reser-
voir , a minimum of four weeks time is required to obtain
Health Department approval of the water sample analyses.
Therefore, the District recommends that all four contracts
be extended to the April 15, 1987 completion date.

contract for Traffic Signal Installation at East "H" Street
and I-805 Northbound Off-Ramp in City of Chula Vista, CA

Informal bids were received from three (3) qualified electrical contractors to
install the traffic signal at East "H" Street and I-805 northbound off-ramp to
replace the existing three-way stop. The project was included in the 1986-87
CIP. The project consists of installation of a new fully actuated traffic
signal .
RECOMMENDATION: That Council accept the bids and award the informal
contract to MCR in the amount of $22,197.00.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Bids were received from three contractors as follows:
1 . MCR Electrical Contractors, Inc. , Imperial Beach $22,197.00
2. Cal-Vista Electric, Chula Vista 25,625.00
3. TCB Electric, Spring Valley 28,800.00
The low bid by MCR was below the engineer' s estimate of $23,000.00 by $803.00
or 3. 5%.
We have reviewed the low bid and believe it to be excellent and recommend
awarding the contract to MCR Electrical Contractors, Inc.
The CalTrans permit to allow our contractor to work in State right-of-way is
expected to be received by Friday, February 20, 1987.
FINANCIAL STATEMENT:
Funds are available from the following account:
Project #TF-115 Traffic Signal-H and I-805 $112,000.00
Funds required for construction:
a. Contract Amount $ 22,197.00
b. Contingencies (approx. 10%) 2,220.00
Total Funds for Construction of Project $ 24,417.00
FISCAL IMPACT: City share of maintenance and energy costs.
