HomeMy WebLinkAboutAgenda Statement 1987/02/10 Item 8 COUNCIL AGENDA STATEMENT Item 8 Meeting Date 2/10/87 E' , ITEM TITLE: Resolution b4 j ` Approving extension of time for 165 Murray Street violation corrections SUBMITTED BY: Acting Director of Building and Housing, _ (4/5ths Vote: Yes No x ) REVIEWED BY: City Manager gr At the City Council meeting of August 5, 1986, the City Council gave direction to Mr. Raso to remove the storage shed from his property and to correct all of the other ordinance vio- lations existing at his home within 120 days from the lifting of the Stop Work Notice. The 120-day allotted time period has expired and an additional 60-day extension is needed to complete the work. RECOMMENDATION: That Council adopt the resolution granting an extension of 60 days time to correct the violations. BOARDS/COMMISSION RECOMMENDATIONS: N/A DISCUSSION: The Stop Work Notice was lifted and permission was granted to resume work on September 2, 1986. Since that time, Mr. Raso has lowered the roof height to 35 feet, made the architec- tural changes requested, finished the entire exterior facade of the house and has removed the storage shed from the rear of the property. He has corrected all of the exterior vio- lations and additionally has completed all of the exterior finish work in an effort to make the house less controversial and more presentable to the neighborhood. In his zeal to improve the external appearance of the house, he has exceeded the allotted 120-day time period without having opened up the internal area above the swimming pool . In order to reduce the total lot coverage, it was required that the area above the indoor swimming pool be opened unobstructed to the sky. This work involves the removal of the second floor and a third floor deck above the pool area, and the construction of exterior walls in the interior of the building to form a weatherproof shaft to protect the rooms surrounding the pool . Mr. Raso feels that he has neither the time nor the expertise to accomplish this work and he is presently soliciting estimates on this work from contractors. As of this date, Mr. Raso has exceeded the 120-day time limit allotted by the City Council by approximately 33 days. I believe that he has shown good faith and worked diligently to bring the house into conformance with City codes and standards, but the work entailed more time than he had available to put into it. I also feel that his decision to complete the entire exterior of the house first was probably a valid one. Had he concentrated on only completing the code violations within the allotted time period, it would not be neces- sary to ask the City Council for an extension of time, but he could have legally dragged out the exterior finish for many more months, and the neighborhood would have been plagued with an unfinished, unpainted eyesore. Since Mr. Raso has not yet selected a contractor to do the work, and he does not have a commitment on a start date, it is recommended that a 60-day extension be granted to complete the project.
